Alternative Dispute Resolution

Then when this is all done, i hope you deliver OP!

Dont want none of that vague cliff hanger crap ending that Kingdom gave us in his 'cousin talks smack on the internet' thread
I absolutely promise to reveal all but it could be some time as the wheels of the legal system grind exceedingly slow!

It's cool, your name tells us all we need to know :D.

O right OK. Did the solicitors have any input on it? I just wonder if Which is over complicating the issue and the other solicitors don't see it as an issue.

When I had issues the item was covered under the law applicable at the time.
My user name simply reflects my job, I was a podiatrist!
The solicitors supplied by my home insurers gave me advice in 2014, they didn't act for me. I'm now escalating this in order for them to send a letter to the supplying dealer.
Which Act applies is apparently conditional on the purchase date. If after October 2015 then the Consumer Rights Act applies, if before then it's The Sale of Goods Act which has fewer teeth than the CRA.

What are you wanting to achieve exactly?

What have the manufacturers actually said about the fault reoccurring, have you even spoken to them?

I've informed the manufacturer that the fault has re-occurred and they have suggested I return to the dealer for yet another warranty repair. I am reluctant to do this as this still will not show that the item is durable because of it's history since new.
The frustrating thing is that the Consumer Rights Act 2015 would enable me to reject the item as it has already been repaired once, I don't get this protection under SOGA.

If I have any case at all it will have to rely on me proving that the fault was there when purchased, the lack of durability and the massive loss of value to me if the item is sold on by me even after a repair.
What do I want? I want to reject the item back to the supplying dealer/manufacturer and receive restitution in the form of money.
