Am I in the wrong?

full log? rubbish.

his first mail said 'installed and working fine'....not 'it spins up and the bios sees it'...

he indicated that he had tested and was happy with the drive. case closed, no further action kthxbye.

Agree with all of the posts made here - you've done your part - he should have been less hasty to give +feedback. Personally; I'd simply say "Goodbye" (of course; in a nice formal way ;)) and be done with it - you've done nothing wrong.

Dude needs to learn how to buy things

I would second that.

I sold a phone a couple of years ago on ebay....guy pays by paypal/buy it now , I am happy that I managed to make a pretty good price for the phone (sold for £85, he could probably have got that phone for £50) and I pack it up and send it.

A few weeks later I get a message saying that the camera isn't working and he wants a full refund. Initially I remembered testing it before I sent it so I ask for some pictures taken with the phone, which he refuses to send. Being naive about the whole paypal thing, I stand my ground.

He files a dispute with paypal and they freeze the money (and my paypal account too), I then don't really have any choice but to give a refund if I ever want to use paypal again, and I eventually get good feedback.

I get the phone back and guess what? camera works perfectly.

I bet it's exactly the same story....buyer changed his mind.
which is why ebay sucks.

i would tell the guy to return the hard drive, then RMA it myself for a new one and tell the guy to jog on ;)

Quite an interessting read this. :D

As people have said, make sure you don't give in. You're in the right here and if it did go to court, which it won't as you're calling his bluff, then he wouldn't even have anything to run with.

Stand your ground, you're 100% in the right. Id also withdrawl your offer to help with P+P costs, the guy you're dealing with sounds like a right stupid **** .

Keep us updated

I agree with this. Just say you are under no obligation to pay for the p+p costs and have changed your mind. You are happy to take the case to the small claims court, and will not be replying to any of his e-mails any more, only letters.

Wouldn't suprise me if he had a faulty Samsung HDD before buying yours, and was trying it on to see if you would take his faulty one back. Did you take serial numbers etc off the drive before sending it?

I sold a load of RAM a year or so back and made sure i took as many details and photo's of each stick as possible to avoid something just like this.

Cheers for the responses guys, I am going to starnd my gorund, but I don't go back on my word so ill leave my offer on the table.

Hi

I have to purchase packaging specific for the drive and then
pay for secure delivery. If i could have done it cheaper i would. As it
stands its going to cost me to purchase the packaging and the secure
delivery is £6.

One of the reasons i was so miffed at receiving a faulty drive.

Unless you can send me a HDD box with foam and an antistatic bag? I'll
pay half the delivery then.

How much does it cost for small claims anyways. The drive isn't worth that much?

EDIT:

Is the box with the polestyrene balls, antistatic bag and plenty of bubble wrap not enough for RMA or do you need very specific packaging?

Thinking about it, I would NOT help him too much, let alone give him money.

If it DOES go to small claims, he's could claim the fact that you gave him money as a partial (or full) admission of guilt.

Ain't worth the hassle.
