Am I missing something or is this misleading...?

So I heard of this deal via HUKD, thought I'll register and make use of it, £10 off Giraffe is brilliant. After doing so the Sunday past, I got an email yesterday thanking me and giving me £10 voucher to spend at Mamas & Papas if I spend £30 and above.

If you were to visit the site, would you see it as misleading?

I there is a * any where on the page that means that there are certain terms and conditions.

These terms can be anywhere on the companys website.

Its it miss leading? Kind of but when an offer is too good to be true it normally is.

Is it legal? Sadly yes it is as long as t n c's are there it is totally legit.

It's misleading if the asterisk isn't explained on the same page or it doesn't direct you to the T&Cs from the page the advert is hosted on.

Personally I'd complain and be chasing a refund.

A refund for what?

Whilst sneaky, all this is doing is prospect/lead gathering, a payment wasn't made ahead of time.
 
Well, I've not lost anything apart from giving some of my details for their marketing purpose. I've tweeted them and it seems Giraffe is more bothered than MM&PP, as MM&PP have been actively responding to all but my tweet.

Emailed politely to them to see what they make of thier misleading page, 24 hours to wait for response. In the mean time, I've alerted ASA. * with no visible / leading to T&C is bad, technically cheating for peoples details for their marketing spam under the guise of another company's gift card tipped it for me.

I wouldn't have bothered if they said £10 MM&PP vouchers.
 
It's still a giraffe grift card, it's a name not a product.
Misleading certianly and I wish they would ban it. Similar to putting farm pictures on battery eggs and other common advertising practices.
But this is why you need to read t&cs.
 
At the top of your picture it says:

Free standard delivery on orders over £50 *
* terms and conditions apply


Perhaps the 'Terms and Conditions' cover both the 'free delivery' offer and the 'giraffe' offer, as both those items are marked with an asterisk and the asterisk states 'terms and conditions apply'....
