Analysis of crash (OcUK Crash investigation team needed)

My friend had an accident yesterday, I'm not too sure who will be held liable by the insurance, I'd like your opinions and views on the situation please.

Blue is my friend
Red is the car which hit him
Black is a van parked on the road. (About 10 feet from the corner, not quite as pictured).

Ok here is the account of my friend as to what happened:
He was emerging from the junction, signalling left. As the van was partially obstructing view, he was "edging out". The car which hit him was travelling down the road (right of way).

My friend was about 2 feet over the white line, his front wheel was just on the white line (Ford Ka) and whilst he may have been moving, it would only have been edging forward on the clutch - he hadn't started to turn or anything. The car (which looked to be going rather quick, maybe over 30), rather than going straight into his front end, swerved to the left and hit is rear quarter panel, and his drivers door. So it would appear the point of impact was on the other side of the white line.

Thats the account I was given when I spoke to him earlier, also when the person (<20yr old, tarted up escort) got out of his car the first thing he said was "I wasn't speeding!!1"
I'm obviously biased, but I am leaning towards the side of my friend regardless. The road is a good 20ft wide, no oncoming traffic, broad daylight. There should have been plenty of time and room (IMO) to slow and go round him


What is your view on the crash?
 
It may have been the other guys actual fault but that wont matter... he had right of way so its your mates fault as far as the insurance will be concerned. You would have to have god himself as a witness to get any other result really.

I though that might have been the case, if he would have been behind the white line (but still moving slowly) at the point of impact - would the same still apply?

If he got hit sat at a junction behind the white line - hell yeah, that's not his fault.

But over the line you're into enemy territory imo - you have no right of way over the white line.
 
Cheers guys, I'll speak to him later and see what his insurers have said.

As a side note, remind me never to have an accident in a Ka - his bounced into the wall and off again, about 30ft from where he started :eek:
 
The van is parked illegaly as you have to be x feet away from a junction, but it is his resposibility to pull out, not the other guys responsibilty to dodge people who are pulling out :D
 
That exact same thing happened to me although I was the red car. I was in my rusty old Fiat Uno Turbo many years ago and a Sierra pulled out on me. SMACK! While exchanging details, he said "I didn't see you mate, that van is blocking the view". My answer was "So"!

He lost...
