That sucks.

I had a similar incident, guy hit me, denied all knowledge of it being his fault at all and then jsut went on to make lots of presumptions as to what I must have been thinking and saying at the time (those made me laugh the most, I mean of course he was in the car with us when he hit me so knew what we were doing/talking about).

My betters half's father used to, er, work for the government (can't say anymore :) ) and he helped me write a letter that absolutely destroyed any credibility to the story.

If it were me I would be appealing and setting out a case outlining where the driver of the lorry was in the wrong and you were in the right leading up to and after the incident. i.e. him contravining the highway code while you followed it to the letter, you stopping to get details and him giving false information etc.

highway code clearly states:
Laws MT(E&W)R reg 12 & MT(S)R reg 11
"The right-hand lane of a motorway with three or more lanes MUST NOT be used (except in prescribed circumstances) if you are driving:-
* any vehicle drawing a trailer
* a goods vehicle with a maximum laden weight over 7.5 tonnes "

That doesn't apply as the 'motorway' either side of the dartford crossing is actually an 'A' road. The A282 if I remember correctly! (I could be wrong :o )

What happened to you sucks and if you have this morons details I'd report him to VOSA. His probably not running his vehicles to the standards required by the Ministry of transport.

Was he the owner of the vehicle or a driver of a firms vehicle?

The thread upsets me just reading it. I can only imagine what you must feel like. Lack of expectation and respect for our legal system is pandemic these days and this sort of case highlights why.

I wonder if I would consider moving out of the country if I was slighted in this way?

I read through this yesterday but it really is terrible. How can that judge claim that a 28 tonne vehicle would not move your car off its course. It would have caused more serious damage had you both been stationary though.

I'm not sure what to say. I have no legal knowledge so I'm not sure how you could go about taking things further or appealing.
