Picture the scene, Im driving along a NSL road and a van is doing 40mph, I overtake the van in the distance there is a coach so i decide to tuck in behind the Honda Jazz infront of the Van.

However the jazz driver decides to brake for me thinking I am going to go past him too, I now have no where to go and already commited to braking so can't simple jump back out as I would head on the coach.

S2000 brakes are good but not that good, I end up bumping his rear bumper and stoving in my passenger headlamp into the wing.

Why can't slow drivers just keep driving slow and not go even slower trying to help :(

I just don't know why people think they are helping by changing the situation.

Plus it was downhill so Vtec got some torque y0

Also the highway code;

144: Being overtaken. If a driver is trying to overtake you, maintain a steady course and speed, slowing down if necessary to let the vehicle pass.

Sorry mate but dont see how its his fault

He didnt maintain a steady speed, nor was I trying to overtake him.

You don't expect a car to brake when there is nothing in front of him and no reason for him to

It wasn't really an impatient overtakes, just one of those ones where you are keeping the momentum up. :( Wasn't helped with sunglasses on whilst going under dense trees.

Hopefully I can sort it pretty quick as the weather was great this afternoon.

Ive been thinking about this some more. When the lady got out the passenger seat she said ' he thought you were overtaking and so he braked'

On reflection I had braked enough to get back in, I think he actually panicked and breaked far too much. After I hit his car we stopped within about 2 seconds so must have been doing about 15-20mph maximum.

I have tyre marks on the side of my front bumper from his rear wheel, if we were going any faster then he would have span.

The guy literally crapped himself and slammed the brakes on. I wasn't going much faster than him when i was 'tucking in' the fact i was braking and he was still getting closer was cause he was braking.

Wonder if the disabled badge was anything. He looked physically able to me.

Here's my car now. notice the front of the bumper is fine.

It was more of a case of me going into the side of his car, as i had no where to go

Headlight is broke, Hopefully it just needs a new unit and the adjustment etc is ok.

Can see all the rubber from his rear tyre on the bumper too.

Mondeo driver did what your Jazz driver did - but I guess if anything it faciliated in me overtaking both of them.

Hindsight is a wonderful thing. I had already commited to tucking in and then i was screwed as I had lost momentum.

The irony is I thought I would be sensible and tuck back in rather than screaming past both vehicles at 9000rpm. Wish I deafened them now! :D

I drive the road everyday from work, its the only place to overtake and after that its 5miles before a 30mph zone into town. Sat at 40 is very boring and slow and pointless. I had every right to overtake

Yes it is easy to be holyer than god on a forum but it was a sunny day and they were interupting my Vtec y0 :p ;)

If the guy had carried on at 40mph then there wouldn't have been an issue, but he even found that too fast for me

******** IMO. You overtake one, then the other, then the other. It isn't rocket science.

It was only them two and the road would have definately been clear afterwards hence why I took the choice.

An on-coming large vehicle is certainly not the best of overtaking situation - I'd hazzard a guess the coach was exceeding his speed limit and you had'nt possibly appreciated this until too late.

Heh I bet you have seen it a lot.

I didn't misjudge the speed, just rather prefered to not look dangerous so chose the safer option :( Should have kamikazeed the coach now

It all depends on how long you're going to be on the road and how safe it is to do so i suppose. On the road i travel there is only about 2 or 3 overtaking spots and i'll generally only overtake someone if there is 1 or 0 cars in front which i can see. Weaving in and out is likely to cause an accident, possibly similar to the one Simon had (not saying simon was being unsafe, just highlighting what other drivers can do in those situations)

I rarely weave in and out. I simply aborted a 2 car overtake and would have then been happy to sit at 40 all the way back to avoid a close call with the coach, which was in the dark shadows of the trees I was coming up to and I had quite dark sun glasses.

It seems to be a combination of factors that have gone against me. If it wasnt as sunny I wouldnt have had glasses on and would have took both of them no doubt

I'd normally get annoyed with people weaving in and out myself.

Oh and make sure your in a low gear so that you can avoid those muppets who like speeding up as you overtake them :).
I'm always in a low gear.... I drive a Vtec :D

I could have braked harder i guess but i was aware i was trying to get in a closing gap being closed by the jazz with a van still behind me and so if i braked too much i would have outbraked the van and been in an even worse situation

Oof! You say "if" he decides - I take it the damage was quite minimal to his car, or are you thinking about if he decides to claim multi-thousands for the mental anguish?

Lol, well I said take it to a honda garage and Ill pay for it. He muttered something about his warranty. So had to tell him that wasnt affected.

I know somepeople think insurance company repairs are better than normal repairs for some reason lol Only problem I guess is that he will be without a car. Ill have to sweet talk him tomorrow. Oh and tell him to not brake next time :p

if his gonna be without a car, his likely gonna be expecting you to be paying for it?

Hope your a good sweet talker. :p
Should be done in a day, if not Ill get him a hire car.

Option 2 would be him claiming and I lose 3 yrs NCB :( 25 with 0 NCB and group 20 =££££££££££

Thought you only lost 2 yrs ncd if you have to claim? Or odes it vary from comapny to company?
God knows. Wouldnt make sense if you have 1 yrs NCB and it had been 2 months since the last claim though :D

Sometimes they are.

My insurer covers any work done for 4 years, can't think of any places that would give me that length of cover on it. Infact the garage I went to said that if I went in independantly the work would only be covered for one year. Same garage, 4 times the length of cover on any work done

Wierd. I suppose thats an offer of the garage to the ins. company so that they get the business.

I just rang the guy. He rang his ins co. to claim. What am I supposed to do now?

If I do pay for it through his insurance company, (he did mention to them that I would be happy to pay) does this still count as a claim against me despite me paying for his damage? Or is it simply an accident and I get to keep my NCB?
