I'm so sorry to post this as I posted another work related issue about me but I get a lot of opinions here :)

my work has a no internet usage policy. today at work a mate was on bebo. she was told by her manager to get off the website and was given a discussion record. my mate said that her manager told her that it was misconduct. when my mate left, IT checked her computer and printed off a few pages of the websites she has been on. My mate has been invited to an HR interview and is worried.

She has no warnings on file and has worked there for 4 years. Can she be sacked?

Tough! Shouldn't have broken the rules.

Facts:

"work has no internet usage policy"
+
"today a work mate was on bebo"
=
"naughty girl"

Simple really

It depends what is on the internet history usage. If it shows she was on the internet all day and this is a thing that shows up in previous history yes she can. If she went on bebo (lol bebo) for a few minutes then there is not real justification for anything other than a warning.

I don't think she could be sacked without a warning first.

I thought that as well, especially if it's "Misconduct".

If it was "Gross Misconduct" then yeah, instant dismissal, but a simple Misconduct case AFAIK does warrant a written warning.
