Appreciate this may be kind of naughty, and frowned upon but just wondering if someone could check over literally 44 words of my contract. Won't take longer than 2 mins, just wondering if my contract is enforceable. Its not even an employment contract, its a contracters contract.

I basically used to work for [COMPANY] selling keyrings in a nightclub, I left on the 23rd November 2013. I have since left there and do it myself in other venues but also sell photos as well as keyrings, I sometimes get paid but sometimes do it for free for venues and I put the photos on their facebook page. I presumed I was doing this without breaching any contract.

Recently a venue that I used to work for with [COMPANY] asked me if I can do photos for them after getting rid of [COMPANY] for not being happy with their service. [COMPANY] then asked if I took photos for the venue that they used to operate in as they recognised my photos on the facebook, I said it was me but I work on the bar and I just took photos for 30 mins (which is a lie - shouldn't have said this but I paniced thinking I was sueable). When I said that they then said I can't work in a venue on the bar let alone take photos.

[COMPANY] are now telling me I can't work for other venues (that they don't even operate in) and that I can't work in the venue they used to work in either until 360 days.

Also, this was a digital contract I was asked to just send a photo of my signitatute with my name printed which I did over facebook.

The 44 words that stop me from this:
my contract said:
Contractee is not permitted to work for, with, or in conjunction with any employer or contractor whose business conflicts with [COMPANY] which includes self owned businesses or partnerships for a term of 360 days following the expiration date of this agreement.

I'd rather not go into detail and post it publically, am more than happy to get opinions from people not qualified!

you need to enable "trust" of which you already have..

click the trust button on a users post you wish to contact.
click "send email message"
 
Look, if you share it with someone privately they are only going to post it here, or somewhere even more public, or maybe just email it direct to your employer, so you may as well share it yourself. Relax, you're amongst friends on this forum. It's GD - what could go wrong?

Appreciate that, but I'd like to think it wouldn't get posted. I don't want to run the chance of the company finding it on the net. I hope whoever I sent it to understands this.

I think it's vague, unenforceable and unfair in its restriction but I'd also seek proper legal advice if you're concerned about it. This will be Solicitor 101 stuff for even a undergrad lawyer.

Without us knowing what the contract is about/says has mags actually posted some real good advice? :eek:

A qualified lawyer is unlikely to be comfortable with receiving something in Trust and offering an opinion since, due to the directness of the request, there is potentially an issue of creating a legal relationship. I understand that you are uncomfortable with posting publicly but that is your better option. I would happily make some comments in that circumstance.
 
I read the message in trust, I see why OP was reluctant to post the clause, however for those that are interested...

the clause stated does actually make it a sackable offence to run round the office drunk, naked and with a live chicken on your penis, the fact you had you own poop smeared on your face also makes you fall foul of the hygene clause as well....
 
OP.. post the section that concerns you as an image? Much less likely to be found by search engines then and you can remove once done without fear of the text being indexed.
