I guess it depends on who was doing the initial ‘racing’. If he was speeding first then it could be easier than if you were the one who did the instigating. Also can a police person encourage someone to break the law to then arrest them?

Would the prosecution be any different. Surely he would be getting charged for dangerous driving / excessive speed regardless of whether he was "racing an undercover".

I've had it before where an unmarked unit was right under my rear bumper trying to push me into going over the limit. Thankfully I'd already clocked he was a copper and stayed bang on the limit.

He pulled me anyway and was looking for something to do me for, found nothing and tried to make something up. Told him it was nonsense & that if he continued a formal complaint regarding his behaviour would be submitted, along side the audio of the conversation caught by my dashcam & the rear cam footage of him dangerously tailgating me.

He got in his car and left, angrily.

Made the complaint anyhow and the outcome was he was booted from traffic as it wasn't the first complaint of that nature & his own on-board confirmed my own footage.
