Are Deliveroo liable?

Friend steps out of garden onto pavement to almost being hit (hard) by a Deliveroo ebike riding illegally on the pavement.

Would Deliveroo be liable for any consequences or would it be the individual rider?

Out of curiosity.
 
Probably the individual, assuming they are self employed contractors effectively, working from an app right?

I bet they don't have public liability insurance either.

But Im just guessing.
 
As above, remove "Deliveroo" from the equation.

Makes no odds who they were working for / what they were doing. Even if a normal cyclist hit you whilst walking on a pavement they'd be personally liable.

Was your "friend" hoping to bag a free takeaway?
 
Ok, so after work in going out jumping in front of some deliveroo drivers, who's with me?

If you live in a high-rise flat, look out your window and wait, you may be able to time a drop to ground level right in front of a Deliveroo driver. You may also be able to get them to pay for any medical expenses and emotional damage caused by having to hurt yourself in order to claim compensation.
 
Does that policy assume the rider is riding in accordance with any laws etc? I.e. i'm not sure if Deliveroo's insurers would be happy paying out damages if it was found that the rider was negligent by riding on the pavement.
From how I read the quoted information it only covers those who are working for them unless the person who posted it left out the actual information related to if their workers run someone over whilst not adhering to the law.
 
If the rider was acting on behalf of Deliveroo at the time of the collision rather than riding home after their shift (I know there was no collision this time) then they are liable. Their insurance may, or may not, cover it. But Deliveroo itself would still be liable.

It probably does as long as it's a true ebike and not a electric motorbike per legal definitions.

Edit: although could be excluded by this general clause

Each Beneficiary must take all reasonable precautions to prevent and minimize loss or damage of any kind (including, without limitation, the risk of Claims, Personal Injury and Property Damage)
