Your OP seemed to infer that it was the Merc driver's poor driving that caused the accident, coupled with the poor driving of the French car driver. I took this to mean that you were attempting to shift blame onto them. Apologies if this wasn't the case :)
 
If in doubt, slow. At least in that instance, if the 'tard behind really isn't paying any attention they'll run into you and you'll have a good claim, instead of having to take unnecessary avoidance.

My temper got the better of me when writing the OP. Ultimately I am to blame, it is very annoying, but I can't but think if the police was not there the Merc would have actually accelerated to the designated speed limit rather than sit at 30.

Unfortunately, guessing at what people might or might not do isn't a good way to drive - deal with whats actually happening and plan an escape route. The Merc driver was doing what he was doing and you have to adapt to suit, police or not!

I know you are shouldering the blame here, but you are also trying to mitigate / excuse your actions with what everyone around you was doing, when it is largely irrelevant!

EDIT: Not flaming you :) Just calling it as I see it :)

Of course it is. For too long now have I been reminded every time about mine yet everyone seems to forget your epic driving failiure followed by 6 months of pretending there was another car on the wrong side of the road :p

At 30 ish I wouldn't have bothered about the car behind braking in time - let him get his ABS going! :p

I've only taken a big risk for another driver once, and even then it wasn't altruistic. After braking to a virtual stop a car was tanking up behind me fast enough that, if one of us didn't move in to the other lane, he was going to smash in to me at high speed. I moved and he screeched up the inside of me at around 60.

Unless it's going to be a serious accident I'll let the other party worry about avoiding it!
 
Nevermind. Alloy kerbing is always a bitter pill to swallow though :( , I would be devastated if I did such to my new alloys hence why I've been awfully careful since getting them on. The Eagles have a rim protector though which should help some what.
 
If you went past the Merc you wouldn't of been undertaking him. Just passing on the inside.

There is nothing illegal about it, or anything the cop could pull you up about.
 
Hilariously backfiring thread, sounds like you were the one panicking and freezing or you wouldnt have been up the curb. Regardless of what you say, you could've slowed down or braked, just suck it up and learn from it.

Same, and what you describe doesn't sound like it would have been classed as undertaking. Seems like it was your driving that went down the drain in the presence of the police car unfortunately.

And I don't understand this beeping of the horn either, who was that aimed at and why :confused: If your lane is closing and you can't fit in you sit there and wait whilst indicating into the open lane, not beep at people who have right of way.

yeah, the cop would have had no sense to fine someone for "undertaking" like that, it's nowhere near dangerous.

Agreed, I'd have "undertaken" without hesitation in this scenario, and if the police had prosecuted me for it I'd have taken it to court.
 
I'd have slowed too, as close as the guy behind was it's not your problem, you don't kno whow quick someone can react etc and you might have been fine.

And if he had gone into the back of you you've got police as a witness that it's his fault for driving too close...
