Argos returs dispute with Chromecast

I purchased a Google Chromecast which when I purchased asked if it was exept from the 30 day money back guarantee and I was told it was not.*

So I got the product home and realised the it was not the right product for my use. I did not open the box exept slightly peel back a sticker to get the product out of the box and then stuck it back down once I realised I was returning it.*

So today I went into the store to return it and the lady at the desk couldn't even get the box open and then she didn't know what the product was. '' her words were what do you use these for'' then she asked another member of staff. When she came back she said we cannot return or exchange this item as it has been opened and my manager has said the same.*

I then asked to to speak to the manager myself. When he came out he said '' What's the problem sir''*
I explained the issue and then he said we cannot return the item as it has been opened, I explained that the product was not removed from the box only the seal was slightly removed. He then went on to say we don't so exept guarantees anymore and my staff would never say that to you.*

I went onto say that you were not here and how do you know what your staff said to me and why would I lie. The person who served me at the time of purchase was also there and said that she told me I could bring it back only it was not open but this is not what I was told.*

The manager then started to get heated and said we will not return your product and put it back in the back and said '' if you don't leave the store in 5 minutes I will call security. I said to the manager there is no need to be like that and he just looked at me all angry.*

Also before the manager arrived I could her the lady who went to call him out saying '' don't return it for him or something along those lines.*

So I ask what kind of customer service is this and with the staff all in a pact the consumer doesn't stand a chance. The only reason I purchased from argos was because I could return it.*

Argos has lost a big customer her and I have never be buying anything from then again.*

So if you guys have had similar issues post them on here as I will not let this go. Also before when purchasing and returning items.

This is ridiculous, do I have any rights as the consumer?
 
No, no rights what so ever unless the item was faulty as you bought it from a bricks and mortar shop. Should have ordered it online then you could have returned it for any reason you liked.

That the sales monkey told you differently might hold some water, legally, but I would suggest not on the basis of the breadth of Argos' offering, and the expected knowledge of the till staff. Basically, it couldn't reasonably be expected that till workers would know exactly which items are excluded from the 30 days.
 
It normally says on the receipt that its exempt. This is the main reason I wont buy laptops/tablets/phones from argos
 
It doesn't really matter what the receipt says anyway - you get the receipt after the transaction has completed, so any terms on the receipt count for nothing.
 
Well that's the last time I buy anything from argos I can always use the Chromecast or sell it on eBay as I'm going to go for the fire stick instead
 
Me too, I thought a mod might have a edited a wall of text and used asterisks to denote the double spacing or something. :p

OP, I would suggest just trying to go to another Argos, you might get someone who is willing to help. I bought a 5TB hard disk from one Argos, that I needed to have replaced, so I took it to another Argos in a completely different city and they obliged no problem.

They'd probably just exchange it for another.

Can't really blame argos, op got what he paid for, the fact he decided he doesn't want it any more is not thier problem, they can't even restock it as the seal isn't intact so it's second hand for all intents and purposes.

If they refunded they'd be making a loss through no fault of thier own. Why would you expect them to do that?

You have no statutory rights to return anything to a shop when it's been opened. You'll have to sell it on ebay. Argos are not in the wrong here.
 
I had to giggle at you saying "I only removed the seal a bit then put it back" like that means anything to them. Think about it, how many people try this on all the time? I'll tell you, lots.
 
If the person on the tills was doing their job properly they should have read out any bulletins, etc. on the till while processing the order which would include the exemption from the money back guarantee. I doubt you'd get anywhere on that angle though as its marked on the site and catalogue fairly plainly as an exempt item.

I would suggest chancing it at a different store as you may get a different result but tbh you don't really have a leg to stand on.

I removed it by mistake before I realised it wasn't the one I wanted so it's nothing to giggle about we all make mistakes.
