ASDA Parent & Child parking - fine for misuse

Just been reading about ASDA starting to fine the mis-use of Parent & Child parking after their initial testing of the scheme. Personally I think it's outragous and I'm glad that I don't shop at ASDA. I've also read that it's not actaully legal for ASDA to fine people, and they won't be able to enforce it. From another forum:

On private land, you can park where you like, even in a disabled space, believe it or not! The marked-out spaces are nothing more than daubs of paint.

While the car park owners have a statutory duty to provide the spaces, the spaces are not protected as they are in public car parks and on roads. The Road Traffic Act does not apply (insofar as parking is concerned - driving is a different matter) in private car parks.

Another thing to think of - it's all very well complaining that there are people without blue badges in these spaces. However, that does not mean they are not disabled and they do not have a blue badge. There is no obligation to display the blue badge in a private car park.

To the poster who said that Asda can fine anyone on their land - that's wrong, I'm afraid. Only courts can fine people. Local authorities and the police can issue penalties, which if unpaid (or if challenged and lost) then become fines, which will be imposed by the courts.

At most, Asda (or their agents) will issue the RK with an invoice. As this is based on contract, it has nothing to do with the RK; only the driver may possibly have agreed to enter into the contract.

I assume that RK = registered keeper.
I'm not sure if the above quote is correct but I'd be interested if anyone here could shed more light on it....
 
I always knew that there was nothing they were allowed to do to stop you parking in a parent+ child space, I wasn't aware that the same was true for disabled spaces thouigh =0
 
That is actually really interesting, but is it true?

Given that there is no obligation to display a disabled badge, if you were confronted you could allege you had man flu ;)

Or herpes.
 
So if they put up a sign saying £1000 per minute parking, but free to disabled badge holders / parent&child types, you'd be happy to follow the land owners rules?

But as they don't charge for parking they aren't allowed to have a say who uses the spaces they reserve.....
 
If careless people didn't open their doors onto my car then I wouldn't have to park in a mother and child bay.
 
Legally speaking its correct - the RK is also under no obligation to reveal the driver of the car to anyone but the police or a council appointed official.
 
I saw an interview with a ASDA bod and he mentioned that during the trial they'd issued about one ticket a month. It was more a matter of getting the idiots to move on to other spaces.
 
They're allowed to clamp you and issue a charge to release the car though. As long as they have the relevant signs clearly displayed.
 
I park in disabled places @ my tesco there are atleast 30 free always but the rest is full up and as i know i cant get a ticket **** them, I dont want the hastle of getting the kids in and out with no space as all the kids spaces are used up

I don't but what does make me laugh is , some disabled people who are apparantly so disabled yet they can walk around a huge superstore :rolleyes:
Is it something to do with the door space? , if so then surelly walking around a superstore with lots of people getting in the way is just as problematic?

What about the drivers that park right outside the superstore on the double yellow lines ( pick up point only ) actually go inside and do all their shopping. I've seen it.
 
Of course they can fine you, how else do you think clamping companies exist?

Whether they would take it all the way to a court is questionable.
 
The ASDA near me has about 200 disabled spaces it seems, there are tons of them. You cant get parked, and there are loads of these spare. Then you get the people who give you a heriffic look for parking in one. Be realistic for gods sake there cant be that many people who need to use a disabled space at one time, its absurd.
 
Parent and child spaces should be as far from the doors as possible, at least that way all the fat brats would get a bit of exercise if they wanted their pies!

Some disabilities aren't easily noticed though by just looking at someone, i have a friend who receives a free car plus the blue badge due to suffering chronic chroens disease, in the case of my dad he has a degenerative back problem so he qualifies for the blue badge through this yet can at times on good days walk about ok on other days he cant.

So some disabled badge holders may look ok to you but they aren't, the ones who do fake it give a bad name to blue badge owners and these should be weeded out.
