Awkward Question - Fraudulently claiming permission

Bit of an odd one, my daughters were meant to go on holiday yesterday to Croatia, there were 5 of them on the flight booking which my daughter booked and paid for and then got the money from her friends (Around £100 each)

The flight was then cancelled which was obviously very annoying. They then spoke to Easyjet who confirmed they'd be able to claim back the costs of a replacement flight. This happened to be considerably more expensive at £480, but it wasn't too bad as they had confirmation they'd be able to reclaim it.

One of the other girls then decided she didn't want to go, and so rang up and claimed she had permission from my daughter to make changes on the booking and then cancelled the booking and requested a refund. Due to accepting that, the other 4 girls are now no longer able to claim the additional expenses incurred on arranging a replacement flight.

I spoke to the travel insurance provider who said that the issue was with the airline and not with them. The airline are saying the case is closed because a refund has been processed.


Now obviously it's unlikely that they're going to escalate it and try and retrieve the costs, but at the moment they're discussing it as a possibility as it's around £400 each they're all now out of pocket (plus additional taxi/accommodation costs due to the delay) which is potentially going to add up to around £2.5k, all because someone has done something without permission.

Needless to say friendships are over, but they were all heavily frayed prior to this anyway, and it could just be that it's something chalked up to experience and move on, but at the moment emotions are high, and i'm just trying to gather information to give her.

Would small claims court be an option?

Yeah. That’s the currently thinking as it’s no small amount to a load of 20yr old girls

The problem is that whilst it’s her actions causing the problem, they’re not “out of pocket” on the original booking and so I don’t know if small claims is even an option.

So the claim would like between your daughter and the airline. With the airline changing a booking that was unauthorised.

The (ex) friend would be an interested party in any claim.

The girls have only got a refund of the original ticket price, not the compensation that Easy Jet had agreed to for booking an alternative flight which was a lot higher

But as far as Easyjet is concerned the booking was authorised....due to the 3rd party fraudulently claiming permission as they had the required details. Although a booking reference which is printed on a boarding card and an email address doesn't feel like sufficient security to make booking adjustments!
Presumably when it becomes financial, you would also need the permission of the card holder.

The issue then becomes who is properly at fault. Easyjet for having crap security or the friend.

I would say suck it up to be honest

Sure they could go after the "friend" for damages but whether they would actually get the money of course...

Are they still in the UK or have they gone?
If still in the UK get them there asap

They will probably far less upset when they get back but if not progress it then

Still here, the only available flight they could find is 7am tomorrow morning, so just hanging around till then. Annoying for them, as it's 2 nights hotel wasted, and especially annoying for me as i've now been recruited for the airport trip at 3am :(

Brilliant thanks. They have tried speaking to someone at Easyjet explaining it was done without their permission and to try and reverse the refund, but it seems to be too unusual for the CS people to follow the standard script.

For now, i've just told them to go, have fun and worry about everything else when they're home

You could have nearly been there by now (depending on time of their flight)

Not quite sure why you think Easyjet are off the hook here. They have made changes to the case that were not made by the primary passenger and against the primary passengers wishes.

Technically your daughters friend committed fraud, against easyjet, but easyjet are liable for allowing it to happen.

Your daughter will need to make take up the claim with easyjet but it should fully resolve its self.

Also as an aside they should be entitled to further compensation then just the difference in flight costs because of all this. Was it a package deal or just flights with EJ?

Yeah, still fairly sure it's on Easyjet. Just didn't know whether the friend was also in the wrong and it's easier to fight against a 21yr old than a big company :p

If so, I'd personally encourage everyone to move on. Friendships already ruined as you said so.... plus then you don't have to deal with EasyJet and trying to get money out of them which will also be stressful.

Pretty much, think it's mainly due to the fact that 2 of them are in college and the other isn't working, so £400+ works out at a fairly hefty amount of their finances and involved borrowing money to afford the additional flight, so if there is any chance of reclaiming it, they'd like to know about it.
 
You might have a claim against easy jet for fraud. As they allowed someone other than the account owner to change the booking.

Surely that is a breach of security?
