bailiff question

right heres the story... i got a parking ticket last year in lancaster and i put the right amount on and got a ticket , I did contest against it but I've just left it and done nothing to follow it up as i have been very busy.
to cut the story short i got a hand delivered letter yesterday to my parents house (which i do live there) saying I owe £220 or they going to remove stuff ?!
I rang them today saying can I do a payment plan as I cannot afford that and he was a right arse and just said no can do they want full payment now.

said i am coming to remove goods ?! I am not even in the house, he put the phone down on me and won't answer the phone to me. Do they have to accept a payment plan if I'm offering to pay some?
It is not even my house ! they can't force themselves into the house can they as if I'm in they will not be getting past me!
 
If you do a search there are lots of threads on Bailiffs.

The key issue is as to who issued your parking ticket. If it was the local Council or Police, you will certainly have to pay it and the Bailiffs could be brought in if it goes that far.

If it was a private parking company, most people will tell you just to ignore it as there is nothing they can do. However, if you do choose that option, be prepared for them to keep hassling you indefinitely, as they want money and thats what they will do.

Baliff's are brutal when it comes to this stuff. I remember watching an undercover program on them not so long back, and any route into your property they will investigate it. In some cases easily classed and breaking and entering.

Dont call the baliff to pay, call the company. asap.
 
Hey, any chance we can fill this thread with objective facts rather than subjective opinion? OP, the important post so far is the one right after your first one. Who issued the fine?

This is untrue.... The only 'brutal' barliffs are the ones that come when you miss pay on your council tax. They HAVE to offer you a payment plan. Well from my experience anyway. Im confused how if you have chased this up.. And you haven't paid since last year you haven't had any further communication? Are you telling us the full story haha?

And if they try to enter my house without me saying come in... The police will be called, and/or the fruit bowl will be around the head.

It was from the council. they are called jacobs cerificated bailiffs im ringing the company now regarding it.
I just have been busy with work and not had a chance to sort it !

Ah, you are most certainly in trouble then.
 
parking ticket last year - too busy to sort it??? Surely you've not been that busy in the last 8/9 months to pay a £30 parking ticket fine that is now £220!!

You must have had numerous correspondence about this as it doesn't just appear after months and months.

pay it up now and stop being silly about it. you could have and should have paid up at the start, if you had a ticket for the time you parked there you should have followed it up when you contested it.

Speak to your parents and get them to help if you can't pay it.
 
So if you contested it, Im assuming you've been to court and things for it?
What was the outcome?

If you paid the correct amount and still got a ticklet I find this very odd

no I never went to court or anything about it. I never got a letter for months about it after I wrote to them and then this turns up!
Tried to ring the bailiff serveral times just to pay the bloody thing but he wont answer calls now
 
You will have more luck setting up an arrangement with the call centre than you will with the bailiff. However, once a bailiff if assigned, you need to discuss arrangements with the bailiff. If the bailiff is not being reasonable, speak to the call centre, tell them what's happened, what you offered and the bailiff's reaction.

probably a ***** run balif firm, they will take the house, your saving and any dags in the local area...
 
Unless you have a CCJ and it is court ordered for bailiffs to come over to your property then they have no grounds to come to your property under English Common Law, the right to enter your property and grounds is a right that can be revoked! Bailiffs/Debt Collectors can be stopped from coming to your property.

They have to accept a payment plan agreed by both parties for whatever you can afford I believe, until a proper payment plan is in place just send them token payments of £1 to show that you are actively looking at the account in hand and that you are willing to make payments. Start making records of every instance of contact you have with them, times and dates of calls made, even if they don't answer, that way it can be logged with your phone records to show that you have attempted contact with them.

You can also send them this to stop them from coming to your door:

Dear xxxx

Account Ref xxxx

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.

Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).

Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

Out of curiosity, what would happen if you were to "eject" or "disable" an intruder in your home, who just happened to be a bailiff?
