Been Capped :/

I think I may have overstepped my Internet usage by a small amount.....

I had this e-mail from my provider (BT) today...

Usage Allowance
Dear Customer,

This email is to advise you that last month you exceeded the usage allowance for your BT Total Broadband Option 1 service.

Your current monthly usage allowance is 5 GB.

Your total usage for last month was 43.79 GB.

Don't worry, we're not going to take any action this month. However if you exceed the allowance next month we will raise a charge based on £0.30 for every extra GB you use.

Alternatively, if you wish to avoid usage charges completely, you can always upgrade to BT Total Broadband Option 3, offering Unlimited Usage for just £24.99 per month.

For more details about this offer or for any other enquiries about this Email, please call 0800 707 6044, between 8am and 5pm, Mondays to Fridays.

Thank you for choosing BT Total Broadband.

Best wishes,

BT Total Broadband team

Opps! :o

BT OPERATOR: Sir, last Monday did you download Star Whores IV: A New Grope, Who Reamed Roger Rabbit and Perverts of the Carribean: Necro Girls Chests?

And yes I'm RTMing my own post in case any of those aren't allowed

What department does you Dad work in? Unless it's the BB area, he'll have no control over your account, meaning it's nothing to do with him. BT does more than just BB accounts.

It's not too much of a stretch that he could have asked some one to look at his account for him.

So i've been lied to ey? I can't beleive they had a list of all the films i had downloaded though :/ I thought they wasn't aloud to look at your data due to the data protection act.

Data Protection Act relates to information stored about you, ie storing details about you, name, adress, etc and storing in a secure fashion not been made availble to other people etc.

Doesn't relate to what you download off the net.

Can someone clarify whether there is a remote likelyhood that BT would/are able to obtain specific content downloaded/uploaded/transmitted by a user? I didn't think this was possible. Bit of a privacy intrusion if you ask me, no matter how large your bandwidth usage is.

I am not referring to the OP's situation here, just a general question.

BTW: OP, AFAIK, in no part of the BT FUP is there mentioned anything regarding speed capping. BT simply start charging per GB after you've exceeded the limit. Something in you/your dad's story doesn't quite click.

Of course they are able but I don't believe they can legally use it freely.

and how do you know that? do you have any proof?

No but seeing as they own equipment that all this traffic has to move through it would seem logical that they must know what traffic is moving through it. Then again by that logic it could just be things like IPs and the like.

Hmm. I'm not so sure now.

Can they ? In theory yes. Do they ? Rarely unless they are approached over a copyright violation usually. Should they ? Yes. You are using a service they provide, they have a right to monitor how you use it and disconect your service if that usage is causing others unreasonable suffering. That said afaik it's not a tool that frontline staff have access to so i'm betting your dad has had a look at your history etc and worked out the rest, it wouldn't be that hard to piece together 'what' you'd downloaded from looking at your PC.

As for the 50Gb/month deal you could have been doing a few gig each month and 130 this month for all we know, it's perfctly possible if it's a staff account the staff member also gets a mail reguarding any issues with the account.

A couple of years ago someone that I know had a warning from BT about downloads, he was given specific film names that were downloaded and specific times. he was informed that unless this stopped his service would be terminated and he may be prosecuted under copyright laws. I think it was the film companies tracing the downloads then contacting the ISP's.
If your using P2P its pretty easy for them to trace you unless you take precautions.

That doesn't necessarily mean that the ISP is aware of everything he's downloading.

dont see what your gripe is to be honest..its not your connection so your dad should be able to do as he pleases..if he wants you to stop downloading he should just tell you though

Of course. But if the ISP is asked it looks like they are able to trace where specific downloads go, I don't know enough obout their technology to give the answer how.

In the example you gave, the ISP weren't aware of what the user was downloading, but someone else told them that they had an IP belonging to the ISP which had been sharing a given list of movies.
It's extremely unlikely that they know what you're transferring unless someone else tells them, but they certainly will know how much you're shifting

This may fall under the Regulation of Investigatory Powers Act (maybe not) or what is in their TOS. Using HTTP to download copyright material is abit silly IMO, it is not hard to obtain the HTTP requests, probably how they itemised what this lad had been downloading. Maybe...

Firstly no i'm not spoilt i pay for everything except for stuff like electric, water ect.
Secondly i don't use torrents.
Thirdly no one in my house knows what i download. However they knew i download stuff and didn't care.
& finally my dad doesn't have a clue how to find the stuff on my hard drive anyway..
