Been In A Car Crash

I was involved in a similar accident a couple of years ago. Stationary traffic, girl hits car in front of her who in turn shunts me. We both claimed from her insurance as she was the cause.

If you did shunt the woman in front then she should be claiming from the person who hit you, not you directly.

No pal. I was in the middle. A women I know hit me from behind and another women in front claims I was pushed into her. However I wasnt. I also arent a fan of milking things. Yes I know it hurts a lot at the minute but dont want to over exagerate.
Chris

If you're hurt mate, then go to hospital and put a claim in if it's genuine. The claim comes off their insurance anyway so it won't cost the woman any more personally.

Someone drove into the side of my car last year (totally not my fault - I was turning right and the lad following me didn't notice as he was chatting to his passengers and drove straight into me) and my head got smacked off the middle pillar/door edge. I had really bad headaches the next day but I just braved it out as everyone was just saying "claim claim claim" and I didn't want to look like I was taking the mick or milking it. I wish I had claimed now. :(

I agree that claiming if your not hurt is totally wrong though.

Pretty much. "Justified" is just another insurance word for "Rob you for more"

How it is even conceivably possibly to assume that someone stationary who has been hit is more likely to be in another accident baffles me.

You can prove anything with statistics.

The statistics will probably indicate that it's true but won't necessarily imply causality. For example, their statistics could show drivers named James are more likely to crash than drivers named John, but under no circumstances does the name of a person have any influence whatsoever on their driving ability, it will just so happen that more James' have been in accidents than Johns. It seems to me pretty ludicrous that the OP's premium will increase as a result of his accident. I'd love to see a watchdog crack down on this unacceptable practice of raising premiums for drivers involved in accidents who make no claim and are cleared for liability.

My neck is feeling even stiffer this morning. I am thinking a visit to A&E might be an idea. I know the woman who hit me though so arent even after any whiplash claim or anything. Would just like the insurance sorted out promptly.
Chris

If you are genuinely injured then you are not milking it. Remember, it may just seem like an inconvenience now but what if you are one of the unlucky ones who never recovers?

Agreed. Post hoc ergo proctor hoc. 1st year of university, basic course in Logic. It was hammered in time and again that causality is not proven simply because one event is followed by another.

Your no claims should be intact but your premium may go up due to the accident, even though it wasn't your fault! Good eh?

In a word : annoying.

It's taken me 9 months to get my no-claims back .... and the £250 refund from my premium. The reason - the recovery company (part of the same group) couldn't sent a correct invoice.

Sorry complete typo. I meant about 5 foot and then 4ish. Didnt move that much really and that is why I know we didnt hit it. sorry about that. Anyhow been the hospital said to take it easy a while and gave me some pain killers. How would I upload photos?
Chris

Why does pain = claim? It's not a cash for it hurs a bit scheme. The point in receiving a payout is to cover benig out of pocket due to somebody elses negligence. If you are a self employer builder and you lose £5k of work because some prat hits you and you cant work, fair enough. But to make a claim because you are a bit sore for a week seems a bit... I dunno really but it doesnt seem right. Sometimes, life sucks. Sometimes people do stupid things. Provided you are not financially worse off as a result why is there a claim in everything?

I was involved in an accident like this befoer I could drive. My neck hurt for about 3 weeks. It was very annoying. It cost me no money. I dealt with it, because life isnt a ball of cotten wool.

yeah, muscular pain isnt the same as whiplash, it could go.
however, there is no harm in getting it looked at.

Not everyone's as tough as you.

I'm far from tough, trust me. And if somebody is the biggest wimp in the entire world how does money 6 months after the event make it all better given they'll have recovered and suffered no out of pocket expenses?

It's adverts like "Suffered an accident. Not you're fault? Call InjuryLawyers4u". Unfortunately general public mentality is:
Step 1: Involved in a crash
Step 2: Slight pain, sore muscles.
Step 3: Claim, profits ££££££.

Racks up the premiums of non fault drivers.
