Not even the feintest idea where to start with this one.

I got hit by a cab last year, gave the guy my name and address (but gave the wrong postcode, what with... yanno, just being hit by a freaking cab) and today I get a call saying I've got post to collect, and it's a claim form submitted by his lawyers which look like they've been instructed by his insurance.

To be clear, there was never any certainty over who was at fault. He's obviously been told by his insurance (or someone in the know) to claim it was my fault, or he'd not be covered, so that's what he's done.

And the insurance company, rather than go after Santander Cycles (who say I'm fully insured whilst using their bikes) they've come directly after me.

So, what do?

The most logical thing would be to write to these solicitors and tell them to contact Santander Cycles, right?

Or am I missing something?
 
Forward the letter to your insurer.
This, assuming you were in a vehicle. Pass to whoever you were insured with at the time of the incident.

Ironically I'm on the other side of the fence at the moment and suing someone for personal injury. A piece of advice my solicitor gave me is not to talk about it on social media. So be careful what you post.

Edit: I see you were on a bike. Pass to Santander cycles insurance, asserting you deny responsibility and asking their advice on how to proceed.

On top of everything else, it's a cab, if he doesn't have all the footage from the cameras (AFAIK it's extremely rare for them not to have at least an internal, and front one*), I would hope he has an uphill struggle in the claim process.

As has been said, forward it to the insurer after taking a copy, with a cover note.


*From what I understand most cabs were early adopters of dash and cabin cams due to the disputes over claims and assaults on drivers, so anything missing should be a red flag if the cab was fitted.

I had something similar, bike hit my car, a year later he tried to claim pi.
It ended up being fraud on his side.
If I were you I would contact Santander, let Santander deal with it, do not contact the claimers solicitors. It will come down to your word and his.
And what damage can a bike cause to cab or even a driver if the can hit you.

say you smelt alcohol on his breath and was afraid he was going to beat you up, so you didn't stick around for long other than exchanging details as he was extremely aggressive and kept slurring his speech
