Hey all, just a quick question.

I bought a DVD set "new" on the auction site and its got the following damage:

I mean it is a new product as it was shrink wrapped. Where do I stand, would this qualify for a refund? I took the shrink wrap off to see how bad the damage was on the lid open and it was pretty bad (don't know if taking that off will affect things). Also is the seller or buyer expected to stump up the postage fee back?

Many thanks :)

hmm dawn is hot, you may have screwed yourself over a bit by taking the shrink wrap off, if its a private seller you may have more trouble than a commercial seller, only way to find out is to message him though, you will probably be expected to pay postage.

If he doesn't agree file a paypal dispute as product differs significantly than described.

Yeah not as hot as Faith though! lol

Yeah thinking about it I shouldn't have done that but to be fair is was the only way to see how bad the damage was given its gonna have to go through a lot of use to get all 39 dvds out!

Booo! buffy rules, do you still want the box set as if so you could ask for a partial refund take a picture and send him explaining, he may argue it got damaged in the post but its the sellers responsibilty to get the product undamaged to you.

hmmm not really I'd rather buy a pristine one for the collection to be honest. Only reason I went for that set as its long since been deleted (and replaced with a cheaper set) and I wanted it to match my Angel Boxset.

Oh dear.. Just got this

wot u want me to do they were perfect wen sent, and u already had, u should ov known u ad em u aint conning me ****** no way. they were perfect

The thing is before bidding I asked a question about the product and got a friendly response back. This person also has a lot of good feedback, either the accounts been hacked or more likely the owner is letting someone sell something on his behalf.

I only have two positive feedbacks as well, he will no doubt return any negative comments to me as well... Damn strange given the seller has 100 ratings all positive.

Does it really matter that much? Just some minor damage. :/

Minor damage on an item sold as new. I didn't purchase for the dvds as all ready had them I purchased for the box so It would match the Angel one on my shelf. Also the item was listed as new, factory sealed and the price reflected that.

He cannot give you negative feedback. Just file the dispute and get PayPal to refund your money.

Were there pictures in the listing showing the box from all angles? If so I'd say it's down to the postie really. If not then the seller has been a naughty git, but not much you can do really as they will blame the postie and who knows where PP will side.

Personally, I would just keep the dvd's. It was probably damaged in the post, which is unlucky for you, but wasn't the sellers fault.

Go the paypal route, he is clearly a cretin with a response like that, how hard is it to type you versus U on a bloody keyboard.

I'm pretty sure its down to the seller to ensure a product reaches you in perfect condition? otherwise people could send all sorts of knackered stuff out and just go "sorry must have been damaged in the post" although Im sure that does happen on occasion

Stock photos. To be honest I don't see how hinge damage like that shown could be created by Royal Mail, it was most likely all ready there.

Heres the latest:

i am telling u now, they were sealed and brand new condition, dnt try n con me trying to give me ur damaged box, like u said u were just buying these for the box, my arse is this why u av change ye ebay name coz u done this before, i have sold others and sent to all over the world n they aint complaint, u a trying to con me, i treat fair customers fair but not con men

If it's a private seller you screwed yourself by taking the shrink wrap off. It is no longer what the seller sold you and you should not be entitled to a refund IMO. however saying that it's worth an email to see if they will do anything.
