He already said that the Boss had a legit WinXP pro key and wanted it instead of Win home.

You sound like u would prefer it if the guy was completely (insert that word here) and had no access to his laptop, due to a little problem with software which was the manufacturer's fault.

FYI, there are legit download locations of windows, u can download it from microsoft themselves.

What he has paid for is the licence, the exact method of installing the operating system is not governed by the licence, so you should have no issue with how it was installed.
 
I bought an Acer laptop earlier this year. I was a bit annoyed that I didn't get any discs with it, but created a recovery DVD disc when it prompted as soon as windows first started.

The recovery disc only contains the installations for the drivers for when the OS was installed, and are probably out of date. And it also does a backup image of your settings so it can restore them at a later date.

The OS is installed on a hidden partition on the HDD, so it will actually be partitioned 3 times. You can request the discs from ACER if you ring up technical support, but they will just probably be the recovery discs rather than the OS.

I managed to merge the two partitions into one using PartitionMagic and change them to NTFS, I could also see the hidden partition but I didn't touch that.

If you install Pro on the laptop, you should be able to download the drivers from the Acer website for the laptop, but it could void the warranty, especially if the hidden partition is deleted.
