What happens if this Mrs Kotak is not in? What if the person who answers the door says that said person does not live there?

Same as what has happened before I reckon. It depends what powers the people who are visiting the address have? (Presumably it also does depend if it really is her address or not!)

What does the court advise you to do in this situation? Have you had any advice from anyone who actually knows rather than just speculation (I am speculating in case you had not guessed)

Then the baliffs will presumably return with the warrant unissued. Although I'd expect them to conduct reasonable attempts to serve the warrant since that is what they have been charged to do so they may make further enquiries rather than just taking a dismissal at face value.
 
Thats why it might be worth going to small claims (county court), and suing for non-payment of the tribunal settlement, as she dosent have to be 'in' with their bailiffs, if they can find a car or something registered in her name then they can take it, i believe.

Its worth finding out about, as 'lesser' debt collectors are pretty impotent and simply rely on the debtor caving in to their pressure......as you are aware, they can be given the run around by simply saying 'not known at this address'

Give the clerk at your local county court a ring and see if they can offer any input.
 
When I spoke to the people at the Enforcement Office they were pretty useless. All they told me was "there's nothing more we can do" and could not offer any more advice :(

Would they help in tracking her down? She has a few properties, so she could always move when she gets the first letter from the Enforcement Section (they send letters first and then bailiffs approximately 2 weeks later).
 
You will need to move on this though, as the statute of limitations may come into play as its already been 5 years....and if they can hide behind that, you'll never see the money.

Not sure if thats the case though as the sum was awarded by a tribunal and warrants have been issued....you need to get some advice pronto, try CAB and your local court, and also the consumer action group website.

I don't think they would track her down, but they could certainly point you in the right direction......also I would make a thread at consumer action group, there are some real experts on this kind of thing there....I ain't no legal expert:o
