Can a policeman with a speed gun at the side of the road issue a NIP by post?

Help settle an argument for me.

My friend thinks that you can get a speeding NIP in the post by being caught by a policeman standing at the side of the road with a speed gun, or being followed and recorded by a police car.

I maintain that you can only get a NIP in the post from either an automated camera (Gatso, average camera etc.) or from a specifically signed and designated 'speed camera van' at the side of the road. A policeman in a car or with a gun can catch you, but they have to pull you over there and then and issue the ticket.

Who's right?
 
You are wrong, he is right. There does not have to be signs warning of a camera as the speed limit applies even when there is no one there to enforce it.

I have seen them standing on fly over bridges with the laser catching speeders and if they can see the vehicle they can get the speed.

If your being followed by a police car they will pull you over then and there.
 
DO you think those scamera vans that were parking (hiding) on bridges a while ago chased after everyone they caught breaking the rules... err NO, they posted them the NIP.
 
Boo :( I was sure of it, mainly because I've seen guys standing at the side of the road pulling people over. If they could just issue by post, surely they'd just do that instead?

I seem to remember there was a thing about vans not having their warning signs out in the right place, or not visible enough, and therefore having tickets they issued invalidated. Have I made that up?

Maybe you're mixing up speed and ANPR, with ANPR they almost always pull you over immediately afaik.

I seem to remember there was a thing about vans not having their warning signs out in the right place, or not visible enough, and therefore having tickets they issued invalidated. Have I made that up?

Yes, although it's a popular delusion. It goes back about ten years, when police forces got some of the fine money back from the Treasury for use in speed reduction schemes if, and only if, the cameras were visible and signposted. That scheme was stopped years ago, and the police get no money from the fines, so they don't (usually) bother signposting. But even when the scheme operated there was NEVER a legal requirement for the signs, it was purely political.

Don't think so - I've seen them quite a bit in London, and been pulled over by one. It's just 3 guys with speed guns at known spots (usually traffic lights) and if they clock you above the limit they pull you and write you a ticket. Luckily, I didn't get a ticket :o
