Can an employer ask to see test results?

Obtaining covid results would come under legitimate interest of U.K. Data Protection laws so they’re within their right to request them - they could argue that without the results, the employee wouldn’t be able to fulfil their work contract

Ah zero hours contracts?

No they only have SSP in their contracts. As they are key workers the company has taken it in good faith to pay them in full if they have symptoms. Which in theory is a good thing because then you don't have people who need the money forcing themselves to work but on the flip side you have chancers trying it on also.

Ah well, either way there won't be anything in their contract for you to enforce disclosure of a test result.

If he's already back in the office then it's probably just arse covering so if loads of people get ill next week and colleagues start pointing the finger at this guy and why he was allowed to return to work, they've got more than just his word for it that he genuinely tested negative.

This sounds like a more plausible reason.

Technically speaking he doesn't have to hand over any personal data if there is no policy on personal data processing as per GDPR, but I would assume there is as it's a legal obligation and your colleague is being a tit.

It's a text message, who's to say they didn't just delete it as soon as they received it and seen the result? I tend to delete texts like this only keeping personal ones.

Asking for it after they've allowed them back in the office is a bit late really, if they want to do this then they need to make sure people are keeping the evidence and therefore inform them before they go off ill and need a test.

If you supply an email address then you get an email as well.

Currently laying on my bed feeling a bit ill with Covid19 (positive test result came through yesterday).

Heading into a deep recession, jobs will be lost and your colleague wants to mark their cards by being difficult? LOL

This.

We've had a number of these cases where I work. Two that work for me as well, absolutely nothing wrong with them whatsoever but they can pretty much get away with it "because covid". I won't forget.

People can feel ill for other reasons than COVID and can self certify for 7 days. Not sure what the big issue is. All you would ever do in that circumstance is say you were ill with x and that’s the end of it.

That said hopefully with all this social distancing and extra cleaning public and work places are doing general seasonal sickness will be lower this year.

The OP is saying it's being withheld on purpose and claiming privacy.

He has refused to provide them due to it being a private medical record.

The difference is you can discipline on the totting up rule of continued absence. Covid sickness is like a free pass.
