cancel contract

hi guys i upgraded my contract last week to an htc one x tried it for a couple of days and cant get along with the phone as i upgraded via the telephone i thought i had a 14 days to decide if i wanted to cancel i have used the phone a couplre of times went to cancel and have been informed that since the phone has been used the contract must continue until the 2 years is up has any one else had this the contravt is with three ?
any advice would be helpful
 
Not sure about three as a network/company, but I would have thought they’d have to comply to distance selling regulations. O2 have a clear policy, as I’ve has first hand experience of it, returning the phone and even renegotiating a new contract as well as handset when you go down the road of ‘I’m not happy with the device’ and I’m within 14 days.

You should call them and just go down the line of ‘I’m not happy and I want to return the device for another’ Don’t ask them, just call and do it.
 
just spoke to three and as the handset has been used the contract is binding even offered to buy the handset outright which they refused, looks like i will have to sell the handset and offset the money to the contract

That's horrendous, how are you supposed to test a phone without using it?!

Dont settle for that, by law they are supposed to give you 7-14 days cooling period. Whether the phone has been used or not is besides the point, id call them up and ask to speak to a manager or supervisor and tell them that they are breaking the law. If you dont get any luck, then go to trading standards and get them to back you up.
 
Spoke to trading standards and they said these mobile operators are pretty clued up, as the phone was used that validated the contract distance selling then does not apply the only recourse i can take is to exchange the phone but by doing that three have the right to make a charge to bring the phone back upto new condition. Well i wont be making this mistake again
