Car scraped

I think the Jaaaaag owner was quite brave telling the OP suck eggs then walking off and leaving his car unattended. There are a lot of people who would have damaged his car in those circumstances :eek:
 
Had an accident? Not your fault?

Go to a third party so it doesn't affect your insurance, cant you do this in your situation?

Doesn't matter whose insurance you claim on, there will still be an incident filed on the insurance database so you will still have to declare a non-fault accident for the next 3-5 years which will likely put up the cost of insurance.

Yup. I once sued a cyclist for hitting my stationary and legally parked car (in a car park bay) when she was pushing her bike across the road. She then gave false details when I demanded she pay for the scrape to be fixed. So after eventually tracking her down (long story) I started court procedings and mentioned it to my insurance company at renewal time.

My insurance went up.

It didn't bother me though. I could afford it and I could easily afford the repairs instead, but it was a point of principle that I wanted her to pay for it.

She settled out of court for the full amount a week before the court date :D :D :D :D It was worth every penny!
 
Had similar in my earlier days. Chelsea mom with her kids in the nice shiny new range rover, park next to my car which was about 3yrs old at the time. Kids open rear doors to get out and put nice big dent in my rear quarter panel. I saw everything happen. Went across and started speaking to her about it and she started screaming at me how it wasn't her fault, there was no CCTV so prove it, the dent was already there etc etc.

No witnesses as it wasn't a very busy time at the car park, so I just waited until she left with her brats and accidentally opened my car door a number of times into the side of her nice new Range Rover leaving a crease in the door.

Petty, but very satisfying!
 
The police are investigating and have the number plate ID. I don't think they can do much and paying my excess to claim would be pointless £350, I would say the damage is £50-80.

Is they a way i can claim off his insurance?, I know the police are getting his insurance details from him:(.

Why would you pay £350, you arent making a claim off your insurance as you are not at fault. Sure they might "hold" onto your excess while this is processed but they will free it up when its settled as you arent at fault!

If you had the Jag's insurance details you could go direct to them and make a claim on his insurance but as you dont then you need to go through your insurance. Make it clear your car was parked and that you have independant witnesses to what happened :)

Now you needed to do it across many panels for the more damage as both panels would have to be rue sprayed etc.
 
Little update.

I have just spoken to the police and they are going to the jaguar owners house today. They are getting me his insurance details and because he hit my car then said it was not him and walking away, then a witness saying he did hit it.

Leaving the scene of a accident without leaving details, The police did not seem happy. The police asked if I would want him to pay without insurance involved but given the situation I have declined and will be phoning his insurance directly.

I am hoping his insurance will deal with it without my insurance been involved.

Problem with this approach is, as I posted before, if they dispute liability and your insurance company cannot recover costs, then they'll treat it as a fault claim effectively, he WILL have to pay his excess (all of it, as it won't be less than £350 through insurance) and his premiums will be sky high with a fault claim to his name.

If he can't go through the opposing insurer his best option would be to just pay someone £100 or whatever to get it sorted and not bother with his own insurance.

I'm sure if you have had any accident and claimed against any insurance company in the past 5 years you have to inform your existing or new insurers, if you don't and they find out they can refuse to insure you.

Maybe someone can confirm this?

I have contacted my insurance company and they said I will have to pay the excess due the driver refusing liability. I rang the drivers insurance policy and they said because he is refusing to admit the damage they cannot arrange a repair on his insurance and I must go through my own

So I am left with either paying £350 excess or paying below £100 to get it sprayed or just leaving it :(. The police woman said she would search the CCTV to see if she can see the car scraping my car but would take 7 days to get back.


I am stuck really with little options open, I think it would be stupid to pay the excess fees and increased insurance bill. I hope the CCTV brings something up but I am not counting on it, I wonder if they could see him scraping the car and then lieing about it what would happen to him.
 
If it's just a scratch its perfectly drivable. As you are adamant of going through insurance (not sure why still) then just lodge the claim but wait for the admission of liability/evidence. As you have an independent witness I'm not sure how he would get out of it...

If you claim through his insurance its pretty much guaranteed that all the top/common insurance companies will increase your premium, so think about that offsetting the price for the damage in the first place...

From experience, absolutely nothing.

Really wish they would throw the book at people who blatantly lie for insurance claims, but it just seems like you can make up any old **** and even if you're proven to be talking out of your **** there are no repercussions.
 
Get his name and address from the Police, and then take him to Small Claims Court. Get a statement from your witnesses and their contact details too.

Won't cost much to do, and with witnesses he'll have a hard time proving otherwise. It's what I'd be doing.

How does that work? You have an independant witness and i assume some photos to back up your "claim" so how can they refuse to progress it based on him not owning up to being naughty? :confused:
