Cash Machine Payout.

A cash machine over the road has been paying out 20's rather than 10's.
They turned it off about 45minutes ago, but my question is:

Who is responsible for the loss?

Do the lucky people who withdrew £20 and were given £40 have to pay it back? What about the ones that withdrew £180 and got £360 :D

My thoughts are this, it's the Banks fault, so they take the loss; does anyone know the actual law behind these incidents?

Bank's loss.

The banks make money out of the money people save with them anyway as they invest it into the market. Also the amount of money they make on credit, i'm sure a few quid wont go amiss.
 
Please tell me you noticed the mistake and therefore took out all your money and doubled it? :D

BTW, i'm sure the ATM will have logs, the bank probably will ignore small amounts but something like £360, they might want it back but I dunno.
 
I think the bank would want it back.

If someone makes an honest mistake and gives you too much money, and its reasonable to expect that the recipient is aware of the mistake, then they're obliged to give it back.
 
afaik you are obliged to pay it back however I would say that the bank would have a lot of trouble proving this is a person just denied that it had given them extra money
 
Like i said - if someone withdrew £10 and got £20, the bank is probably going to overlook it but if it was into triple figures they'll probably make a fuss.
 
they will know who has got the extra cash from the ATM logs and the log kept on the mainframe , my guess is the will just debit your account for the ammount you withdrew

they are ruthless in thier quest for profit

at one time the bank staff could not go home if the books did not balence at the end of the day , it had to be correct

They usually have CCTV nearby - security issues etc.
 
When this happened where I live they found out it was securor that put akk £20's in instead of £10's and £20's so securor was at fault and they had to pay the money.

Still applies....or at least it does for the company I work for.

We balance the accounts at 4pm, and if they're so much as 1p out, it gets corrected by 5pm. If not, anything left unbalanced at 5pm for less than £10 is ignored until the next morning - anything over, we stay till it's sorted....

(I work for in the Treasury of a multibillion £ financial institution!)
 
Obviously they have logs of all transactions so know who took money out and when.

But surely they can't write off the loss of £20 to Mr jones but then persue Mr Draco for £180, that would be discrimination. I expect they can ask for the money but do
they have a legal claim?

Also I'd be very supprised if the bank, who I don't bank with, can take the money straight back out of an account without permission or a court order, that would be theft!
