hi, just need a quick answer as I am not sure.

Now i sell a lot of things each week on Ebay and have a lot of items come through the letter box, some are signed for, some are not.

Now I also sold an item at around £35 but not on Ebay but on another site that I use for a chosen hobbie of mine.
The buyer says he sent cash in a envelope. I have not received this letter/cash as of yet, been about 2 weeks give or take, he says he has managed to find on the net my local sorting office and speak to my postman who has informed him it has been delivered to me.

I am a bit confused how Mr postie would know this particular letter and that it was A) delivered and B) the one this guy sent as I receive so much mail each week via Ebay let alone all other normal mail.

Now this guy says he will take me to the small claims court if he does not have his item or refund within the next few days.

Is he speaking dribble ? When i sell on Ebay I have a 100% feedback score, been a member since 2001 on there.

This was not sent recorded etc, just normal post i believe, and cash in a envelope.

Not had any problems with lost mail before.

Thanks

In which case, the postman would not be able to check records and know that it was delivered.

i agree.. bad idea to send cash in general post.. if the buyer doesnt sort it and send you the payment sensibly then just put the item back up for sale and let someone else buy it.

Even easier... ask your postman about the claimed enquiry when he delivers your mail tomorrow.

Cheers, just worried me when I read he will take me to the small claims court if he does not have a refund or item by the end of the week.

How on earth can he assume I have had the money in the 1st place !

which just to clarify, I have not

Unless it was recorded post he has no proof, his word against yours.

No need to worry.

Cash should never be sent by post unless it is insured, the buyer is at fault here. Have you tried to contact your local sorting office to call his bluff? I very much doubt your postman would have been able to confirm a specific envelope was posted, in fact I doubt he would even be able to speak to the postman by calling the sorting office. Is it even legal to disclose information like that when it's not the person who the mail was addressed to calling?
You are almost certainly being scammed, don't give in.

It would cost £50 to take you to court. I think he's trying to scare you giving him £35 quid.

Umm, where's that thing I bought off you the other week, you know the one with the stuff and things?

I sent £200 second class mail and haven't heard from you since. Have you done a runner with my cash? My postman has uber-laser xray eyes and said it was defo posted to your address and saw you spend the money.

How can I prove that I sent money? I can't. How can I prove it got lost/you recived it? I can't.

He'll get nowhere in court at all.

Cheers to you all,

that was my gut feeling, that he is just trying scare tactics.

nee mind, maybe it will turn up if not, i'll advertise said item again.

I never send cash in the post. Not safe I know that.

I shall look forward to his next email

"hey,

Well I spoke to Bob - our local postman. Fortunately for me he only lives over the road. He doesn't remember talking to you... funny that. And he therefore doesn't remember putting a envelope through my letter box containing cash - that you didn't send. Incidently, seeing as you ever-so-foolishly sent it uninsured or even registered, how would he know? Postman do handle an awful lot of packages you know...

By the way, you probably know this but to take me to small claims court would cost you £50. Ah well, I guess you could take that out of the money you didn't send me.

See you in court, chum."

Use that ^

I felt particularly sarcy

Can't you post your 'buyer's' email text here for amusement??

He's clearly trying it on. Tell him where to stick it!!

These are the Emails thus far:

I have of course changed some things for privacy, marked with XXXX's

Hi XXXXX, Im afraid this has now gone to the next stage with the XXXXX XXXX. Since I haven't recieved any sort of reply from you about my missing goods, I used your postcode to trace your nearest sorting office. I have had a fair bit of luck. As the letter I sent was quite distinct (Small white, with lots of sellotape) A nice postman, who's name escapes me at the mo, assures me that it was delivered to you on either the 19th or 20th of september.
This can only mean 2 things.
1: You've stolen from me (Very Bad)
or 2: The letter has been misplaced at your house

I will therefore once again give you the benefit of the doubt. I will give you 48hrs to contact me, letting me know that you have found the letter with the money and intend to either refund me or send the XXXX XXXXX to me. Or im afraid i will have to take legal action through the small claims court.

Looking forward to your prompt reply....XXXXX

PS All sent mails have been kept along with an email from your postman

NEXT email received

XXXXX,
I have sent payments for hundreds of sales. Funny how the only one that had cash in it goes astray. To many people they could say 'Forget it its only £20'
NOT ME. Ill give you till the end of the week.

XXXXX

thats it

~Ask him for a copy of the email from your postman.

Tell him you dont doubt him, but if he could provide you with the proof then you can shout at your wife/gf/son/daughter/mother who must have taken the envelope.

When he says he cant find the email/lost the email then say "good **** off then".

Complete Scam!

As I was once an xmas postman for a bit, I can promise (probably) that:

a) there's no way on this earth that you could phone up a sorting office and ask about 'a small white letter with sellotape on' and expect a sensible (edit) answer. You'd just get laughed at.

b) Assuming you could get through the front desk (who would not put you through to an individual postie) the postie would not admit to delivering/not delivering a letter/parcel. What's the point in that?

c) You couldn't expect to remember delivering a specific letter when you deliver 3 or 4 enormous bags' worth.

d) You should never ever wear a hawaiian shirt in a sorting office.

Dodgy scammer probably. Does he have any feedback on ebay?

Send him another e-mail.

'I don't have your money, but I do still have the item. Please find attached a video of me using it. Unfortunately the sound is hard to make out, so you will just have to imagine me shouting 'ner ner ner nerrr nerrrrrrr' over the top of the vid.

Many thanks xxxx'

Or just a simple reply 'I AM my local postman - what are you talking about?'

fini

this is my reply to him just:

Still no joy this morning I am afraid.

I would like to know the name you have of my postman though as well as the email you have received from the postman. I am sure that will have his name on it?
