Was caught doing 38 in a 30 zone. Just received the letter in the post today.

1) Will I be offered the speed awareness workshop?
2) If not then how many points/penalty?
3) If I'm offered the workshop then will this constitute a traffic offence and will I need to declare it next time I renew my car insurance?
4) Silly q but will my insurance premium go up?
5) How long will the offence stay on file?

Thanks

3. nope you will not have to declare anything as you dont get any points
4. probably not but it depends on your age
5. 4 years

1) Workshop not always available and then only to those just over the limit, if not offered with the letter I would suspect it's not an option here. You should ask though.
2) £60.00 and 3 points probably.
3) You should always inform your insurance company as if they decide you didn't make them aware they could refuse to pay out.
4) Last speeding fine I had cost me £60.00 and my premium was loaded by £60 as well.
5) Speeding offences accumulate over three years for totting up but have to stay on your license for 4 years I think. After that you have to pay to renew your license without the penalty on. The fact you have been penalised may well be recorded for much longer and insurance companies ask for details over more than 4 years.

Is that definitely the case? Or can I still be offered one when I send back the letter?

Thanks

Here's an interesting Q&A that sort of clears up some these questions. http://www.honestjohn.co.uk/forum/post/index.htm?t=62769

If you haven't had an invitation to a SAC I would ask, although it sounds like you would have been if one were available.

You may not be legally required to inform your insurer but it shouldn't hurt. Safest in the long run to let them know - you could ring up anonymously or even ring a different insurer to ask what would happen if you changed your policy to them?

The last thing you want is to return from a SAC and be involved in an accident that you have to claim on your policy and they start nit picking.

Thanks. How do I ask for the course? Should I enclose a separate letter with the NIP?

From what I recall when I was caught (36 in a 30) I was sent the letter asking me to confirm if I was driving, then a letter offering me the course. I think it depends how much over the speed limit you were, but I don't know the cutoff point I'm afraid.

Cut off point up here is 36mph,

I'd be surprised if you were offered the course for 38mph in a 30 zone.

1) Will I be offered the speed awareness workshop? Very much doubt it for 38
2) If not then how many points/penalty? 3 pts + £60 fine
3) If I'm offered the workshop then will this constitute a traffic offence and will I need to declare it next time I renew my car insurance? Don't know - i don't think so as i don't think you are convicted if you take a speed awareness course.
4) Silly q but will my insurance premium go up? Possibly, but as long as you have no other convictions, it should be minimal
5) How long will the offence stay on file? Will need to be declared to insurance normally for 5 years, will stay on your licence for 4 years, will be counted towards your 12pts max for 3 years

Just got this off the Leicestershire Police website (issuing authority was Leicestershire Constabulary):

"Driver Awareness Courses

We also offer Driver Awareness courses to drivers who have been detected by a fixed or mobile camera exceeding the speed limit at the lower end of the threshold (i.e. between 35-39 mph). In addition we have started offering a similar workshop for drivers caught going though a red light. In both cases the driver has the option of accepting the offer of attendance at a Speed/Red Light Awareness Workshop or duly paying the fine with 3 penalty points. Over 12,000 drivers attended a workshop in 2009 in Leicestershire. "
