As they seem to stick to a roller to apply the chocolate it isn't really an up or down application. However, they clearly land the right side up ready for eating

When they make the biscuit presumable they have a normal biscuit then pour chocolate on top. Therefor chocolate is on the top.

It depends. What do you do with oreos - eat as is with the filling inside or do you release the filling and lick it out before eating the biscuit?
