Classic question, fence has blown down who owns it?

Sounds like Grahame behaved very reasonably, though I'm slightly surprised he agreed to it so readily.

mrbios - the reality is that good relations with your neighbour are far more important that a few hundred quid on a fence.
 
Don't do that because they'll forever want half for everything.

Property boundary issues can be quite be quite complex, and you don't want them using the fact you paid as an excuse to claim you jointly own the fence.

Likewise if it's your fence just pay up. Nice and simple that way.

Very good advice! I'm in a similar position with fencing and also have a shared drive (they drive through our drive effectively) and I always maintain it, put extra gravel when needed - that way I can park more cars on the occasion I need to and they can't complain!
 
I'm back, can anyone recommend a good solicitors?

Before I go on people have said about me going round making demands etc, I was never going round with that attitude but to simply speak to them and communicate, the purpose of this thread was just to find out a bit more information before I went round.

So I spoke to Grahame and he was very civil and thanked me for going round.
He stated the brick wall was his, the fence had been put up by the previous owners of our house, we have lived here 10 years.

We then had an awkward few seconds of silence, I said how about we go halves on a new fence, he replied and said that was a very sensible suggestion, would I like a cup of tea.
Of course I said yes, he then said how would I feel about replacing all the fence seen as it was all rotten. I said yes and shall we get a nice quality one rather than a cheap b&q panel jobbie, lovely he said.
I said I'll get a couple of fence companies to give us quotes and get back to him before I give the go ahead.

All sorted :)
Sorted for now mate, I hope he stays that reasonable. You've got a good outcome for the immediate issue though, which is a good thing, and you've managed to improve relations with your neighbor to boot. Didn't see it going this way to be honest, quite glad to be proved wrong :)
 
Your neighbour is a wuss! Unless he wanted the fence as badly as you, I would have left you to pay for it all.

On the other hand, if the fence benefits both parties as far as privacy goes then I would have gone halves myself.
