Confused about returning a 360 back to a shop that refuses.

Hey guys,

Ive got a mate who's 360 has failed and its past the year warranty with the high street store. I need the links to the website that has a template of a letter to send to the company if they refuse to take the console back after a year. I believe it has something to do with a law that the store has to go with? Thanks for the help
 
Your friend may be better just to ship it back to Microsoft. By the time you get the shop to agree to take it back, the 360 could probably be back from MS.

Or at least been looked at by Microsoft ;)

Yeah I did think that too but its worth a try at the shop. Has nobody got these links? I really cant remember what the site is called...

I'd rather fight my case in the shop before sending it off.. saves hassle if you can get them to cave in and replace it.
 
The warranty is with Microsoft and not with the store so the store can handle your RMA to Microsoft but they don't have to give you a replacement from the store, do they?

If I remember rightly from my days at the CAB....

You have a consumer purchase contract with a store when you buy products from them and an implied term in that contract is that goods are "fit for purpose" which includes another implied term that they should "last a reasonable amount of time".

No one could reasonably suggest that 1-2 years is a reasonable amount of time for a 360 to last before breaking, therefore the store in supplying a product that has failed in this duration has breached their contract with you and you are entitled to a full refund or replacement item.

The store then claims the same back to Microsoft or their distributor, you don't have to deal with Microsoft as you don't have a contract with them.

This is of course just laymans terms, but should be accurate none the less.

Thats what I was looking for. I need some way to convince the store I am in the right before going in there.
 
i''d do this route instead of going through MS myself too, as the refurb units they shipped out used to be notoriously bad at reocurring with probs...

iirc MS now ship your console back when it has been repaired.
