Consumer Advice Required!!

Take it all the way mate, don't let little ***** like him prosper.

Oh and PayPal are hopeless, I've had problems with them before. They couldn't care less.

I know I know, part of me wants to go all the way, but also I really can't be bothered with the hassle. It will take god knows how long until i get a court date and I'll no doubt be at work/uni anyway, it sounds to me as if he' done this before and has a mate who is a solicitor who sorts it out in court. Really its his word against mine, and me being a 19 year old student and (by the sounds of things) him being 40+ (pretty sure hes the father of the car owner) i will be seen as a silly rapscallion.

Its really very frustrating but i can only hope he gets hit by a bus or something, and ofcourse i hear about it!

Still take it to the small claims court - it wont take too long to get to court and unless he's planning to put in a counter claim his words are meaningless. You seem to have all the evidence you need and remember that the legal test is only 'on the balance of probabilities'. You'll should only need to take half a day off of work anyway.
 
Just so you know he can't claim costs from the small claims so the £120 a day etc he can't get.

I think the maximum might be travel costs a push.

Follow it through, he is bound to cave when mummy or daddy starts to see court papers arriving in his name.

Yeah, i'm pretty sure he can't claim for loss of earnings from you either as its you taking him to court due to his mistake. If it was the other way round he could stick it on as an additional cost but if he's the defendant he's OBLIGED to appear in front of it... its not optional, he doesn't have a choice.

Paypal sorted a claim out for me a while back... bought a dvd player that turned up DOA. The seller wouldn't do anything so paypal just reversed the money back to my account and told me its up to me what i did with the dvd player. £160 reversed, spent £10 to get it looked at and £20 to get it fixed... £30 later and i had a nice dvd/surround system. They can be good when they are wiling to help.

Yes, unfortunately theres a MASSIVE loop hole with there whole system though. You can only complain once, i complained about him not sending it. After this, i couldn't claim again for it being mis-sold/damaged. Pretty stupid ruling that means people like this can mess people about.
