Copy right advice

Hi all

I am wanting to use an image of lets say spider man,iron man or any thing else like that free from the internet using google search and then go to images I find lots of cool pics I could V Carve into wood.

So lets say I get a Batman image and V Carve that into wood then sell the (lets say its a plaque) how do I stand with copy right.
I mean a lot of people do this that have CNC machines (I am not saying that makes it right) but is it illegal will I get sued or could I get sued?.

It's copyright infringement and you will be in trouble if found selling, especially if you do so online.

It's still copyright infringement for personal usage, but you could get away with it, as you aren't making a profit.

It's unlikely you will be granted rights, so if you want to sell something, you would have to change it. For example you could probably make Spider-Man if you remove his logos and don't call him Spider-Man.

Almost every single image good search ever returns will have copyright and doing anything with it without seeking prior permission is infringement and illegal.

Copyright is automatically assigned, so anyone's holiday snaps, facebook pics etc, are all copyrighted.
 
oh ok.

I heard (probably not true cant see how) that I sell a bag of sweets (silly example) and it comes with a free sign LOL how true is that.

I wont be doing that just a silly comment I read some where.

So basically I aint making money on the item with the copy right just the bag of sweets even though its obvius ya not really paying for the sweets.

How true is that

just wondering how acurate this is as said by Nexus

If I remove the spider from spidermans chest or the bat logo from batman would this stand up in court or is it really not worth the risk as it would be likely to not stand up in court even by removing the obvius trademark logos etc etc

I imagine dc comics very expensive lawyers could prove that they are still their character even without the logos.

LOL yeah would not be hard to prove I suppose :P.

Meh tbh not worth the risk as I want to make it then EBAY it.

Oh well suppose I will have to do me own design just would have been nice to make this I think it looks cool

Technically not, but who cares as it is in your home.
 
True its unlikey they would find out so I may.

I am going to contact who ever it is I need to seek for permission but I really aint holding my breath on a reply nor permission LOL I will keep you all posted
 
You might be surpised. I know a lot of people aggresively persue copyright, but yet approach them first and they may sell you it for a few quid. The difference between asking and taking!
 
If found out you could be sued. Wouldn't happen until you sold a fair few and someone of significance finds out. DC comic characters being ever so popular would mean that even having some likeness can still infringe, like using Batman's ears, so logo changes wouldn't be enough.
 
Yeah, I wasn't actively suggesting that trying to sell a copy which is slightly different was a good idea, but you often see Chinese sellers doing such things. They tend to create something which is just far enough removed to not cause a problem.

The issue is though that to do that, your market probably won't be interested if Batman looks ropey because his features are all wrong.

Ultimately if you are going to sell things, its a business, you are responsible for it and ensuring that whatever you are selling is liscened. Otherwise you can face copyright lawsuits and hefty fines.

The thing about selling it as something else and coming free with it, is largely just a silly eBay tactic from selling goods which are banned from sale on there, or by their respective owners.
 
Fair ground rides are an example closer to home. Most are plastered with bad renditions of comic book or Disney characters. Bad on purpose of course.
