Debt collection agencies - problems..

Currently having a lot of correspondence for a family member I no longer have contact with. We have the same initials, and lastname and appears debt collection agencies have, well for a while now sent me letters and sometimes cards threatening to send round investigators to find the where-a-bouts of said person.

At first, I started to send the letters back as not at this address. That didn’t work, I then proceeded to use the return address to try and locate the company to call and request no more letters. But the agency letters are from various companies and without ref: number they will not do anything.

I’ve also been getting cards, addressed to the present occupier requesting them to call. I have and they try to coach as much information as possible, I’ve explained I do not know the location or where-a-bouts of this person.

Yet, the letters still persist in being sent, so I’ve now opened them, getting ref: numbers and called. So far its been collection agencies in Hull and Leeds, all for alarming amounts of money. One of them is for over 12K. I’ve explained to them no one by this name lives where I am, despite having the same initials. I’ve explained they have the right last name, and right first initial, but wrong first name. To no avail. They still persist in letters.

I’ve explained its harassment, I’m being pestered and to stop, they say they will. But they don’t. What can I do?

I think what’s promoted this, is that I’ve now had a bloke call at my house to confirm my identity. I never invited him in, I wasn’t about to do so, could have been anyone, and polity asked him to leave otherwise I’d call the police. He promptly left.

I have no debt, and I don't like getting letters for someone elses problems, wish I knew where they were, I'd chop them in to stop this.... to run up debts like that, and not pay - disgraceful - but then this is why I no longer speak to that person, idiot..!! Wonder if he's still in the country.

Basically, to summarise, debt collector have absolutely no legal power to take your belongings and enter your home; they will only threaten you into paying up.

No one can take anything from you unless they have a court order, and they cannot get a court order unless, of course, you have been to court and lost.

Now, to take you to court, the claimant must prove to the court that it is you who owe them money, and of course, as you say it's not you, there is no way they can do that. In the unlikely position that you somehow get taken to court, your personal papers should prove you are not who they claim you to be.

So basically, they are just engaging in scare tactics.

Write to them a good letter, being firm but not abusive. Summarise everything leting them know you are not who they claim to be and tell them to "Cease and desist all further communication" or you will take inform the police etc. It is in fact illegal to harass people and I can dig up the clause if you want to include in the letter. Finally cc that letter to the trading standards. Send by recorded delivery.

I have been harassed by a number of companies (3, cp plus) for alleged owed money and a number of firm letters with a firm tone informing them that I know my rights, and they buggered off.

I would get some free (doh) legal advice. Reason being is that if you have a record of the letters, phones calls etc telling them that this person no longer lives at your address and you have no ideal where this person lives then really they should be leaving you alone. Also you have explained that this person isn’t you just the last name and initial are the same. Surely after explaining this to them they should be taking other action not coming to an address the person no longer lives at or a person that has no business with this family member and equally shouldn’t have any dealings with his financial stuff.

At least if you speak to someone they can suggest the next course of action and what steps you need to take to sort this out. So that you dont have to deal with this hassle any longer. Sounds horrible thou mate hope it gets sorted soon.

Forward them to correct family member?

Ignore them.

He quite clearly said they weren't "his" debts, and he also clearly mentions that he also has no contact with the party in question.

Thank you for the quick replies. CAB seems like a good place to start, I’ve not got all the letters, some of them get sent back, some of them ended up being binned, but I’ve still got the last couple, so that’s a good place to start.

I find it even more amazing, that this person HAS NEVER lived with me. This is what’s making this even more disgraceful. They’ve done a national search, and just found my name and address and decided to letter bomb my mailbox. I’d say I get one or two letters a week, what a waste of everyone’s time and effort.

Makes me wonder if he used my address to run up the debt in the first place, I'm getting my credit file ASAP now I think about it more...

In fairness, six months ago I did call and they did back off, but now they’ve started again, the last month has been worse then ever…

I’ll explain what I’ve explained here to CAB and take it from there, hope this does get sorted.

Oh and I do agree with the statement ‘pay your debts’ - but not all are so honest and pay what they owe, I’d love to know how you run up 4.5k debt at JJB sports on a store card…. That’s amazing, but the black horse personal loan for 12K was impressive.. some folks eh? Odd, but none are from actual high street banks, all seem to be GE money, or Capital one or store cards… M & S money Credit card was another.
