I had an i3 540 at stock speeds in a Sugo SG05 case, stock cooler and it idled under 30c.
Make sure your cooler is seated correctly on the CPU and apply a good TIM paste (not too much though).
Also try and keep the path from the front case fan as clear as possible inside the case so the cool air reaches the CPU cooler.

Just a thought, do you have all power saving options enabled in bios?
And the 'power saver' option selected in windows?
It might be safe, depending on how high your load temps go. Either way it does seem like a pretty high idle temp for an i3 even if it is in a mini itx case.
Clean the TIM and reapply and reseat the cooler, you should be able to drop it below 40 I would think
