Inclined to agree with the above posters in this case. The rules are clear and he has been flouting them. There are plenty of good landlords - you've been unlucky with a bad one. A couple of letters wont take you long. As for going to court its entirely up to you but it sounds like the law would be on your side in this case if the facts are as you have presented them.

Stop being a damn wimp and teach this scumbag a lesson you have this case practically in your lap and will get more money than your initial deposit back. instead because you cant be bothered he is going to continue doing this to tenants and getting away with it. If you do nothing about this you should not be able to look yourself in the mirror.
