Did Android Copy iOS - Really?

I don't know law, but from what I've understood from others, this isn't the case. That's why people talk about prior art. If it's been in use already, you shouldn't be able to patent it.

They are apparently changing patent law to make it the first to file, rather than the first to invent/use, which to me seems rather odd. Surely the point was if you had a great idea on a new way of doing something, a patent should protect you. This new way, it wont if you don't fill out the paperwork?!!?

It makes total sense if true. It's totally un-workable at the moment. How does a patent office know if there's been prior use? And how does a company prove no prior use. It's a very silly system, which means it has to go to costly law courts, which small companies can't afford.

First to file, would solve this problem massively and massively help small companies.

that's not true, patents are very expensive items to gain, only large corps with mass cash can afford cover all bases patent applications

And it costs even more to defend them or challenge them in a court of law.

So such a system would still slash the price as once you've got it, then there's not much to debate.

I think the complete opposite, its going to be even easier for patent trolls to sit on patents without even the need for development and milk the industry when it comes to licenses...

Going to make it even harder for small companies to get that step ahead as I doubt many of them consider patents (due to the costs involved) until theyve considered prototyping or route to market.

It can't be honestly argued that Android hasn't copied iOS.

What can be debated is whether that copying is wrong. I don't think that there's anything wrong with realising that capacitive touchscreen phones are popular and making one yourself.

iOS isnt the first touch screen phone so its not like they developed the whole idea of touch screen phones, they clearly copied it from someone. What apple did was make it simple and market the hell out of it, but they wasn't the first. How anyone see it as copying is kinda silly, this is how all things work. If someone does something in a way that the public likes then surly everyone else well want it, it can be said by almost everything you see.
