I'm guessing that he is judging ethics on that question, since he is a student from the UK and not from India, China or Russia where piracy is so high that microsoft sell their o/s for about a fiver.

Nowhere because it's not true. It's a civil matter, but it IS illegal. I think you're confusing illegal with criminal.
