When I used to work in Tesco our policy was, if someone was overcharged, we would refund the difference and then give them the difference again.

So if advertised for £1, but they got charged £1.20, we would give them their 20p back, and then give them 20p again.
 
If it was listed that price and you bought it, it's legally yours at that price. there was a series not long ago, something like "know your rights" and this was a question. Wonder how this worked out for the guy
 
I think the funds being debited and the funds being held are diffrent my funds are un touchable by me. but overclockers can still debit or cancel them so im not sure how that would stand all i know is i have no access to them and the order is cancelled so im out of pocket at the moment for their mistake.
 
eh well......not how the law interpret it, at least not how I remember contract law, thats not how false advertisement works. False Advertisement is advertise for a Beefburger but you only get a veggie burger.

Think of the transaction like this

You see sticker price (whatever it is)
You take it to the till and by handling over the tile you are offering the retailer a price, he will suggest x price.
You hand over the payment - Offer
He accept - Acceptance
(consideration for Bargain) and Mirror Principle (Both parties accepts the terms of the contract, in a simple transaction theres mostly just the cost and the item)
Contract is formed.

So if the sticker says 1p and then it scans in at 2p and then customer hands over 2p then he/she is offering 2p. If he/she argues that it should be 1p then the retailer has the right to refuse sale totally and then subsequently can adjust the price accordingly for the next sale. If recieve an confirmation email and the funds in my account are set aside for the said item its later the next day anyone contacts me about a mistake. Thats not an error thats bad all over.
 
I ordered the same pc and im in the same mind frame as you because they have sent the fund authorisation request and the money is with held from my account. the payment procedure has already begun and the money is not available for me to touch so the contract has started in my opinion.
only 7 people noticed the blunder too so they should really of honoured the sale.
its a lot of money but its their mistake and the way they dealt with it is seriously bad service.

I agree i feel it was bad of them. The customer service rep i spoke with said it was a computer error why did they confirm the order and allow the order to be placed. And why when the error was spotted was i not informed until the next afternoon why not the morning. So far i have funds tied up in my account i cannot touch due to this blunder and the only response from overclockers is a 2 sentance email that explains nothing.

Very very poor blunder from a company that specializes in IT.

It will be interesting to see if overclockers reply to my emails as of this time none have been replied to.

I was under the impression it's not until the product has shipped, that the money can be deposited in their accounts and the transaction 'done'.

Any point before that, they don't have to sell it to you.

I have had a few naughty e-tailers take the money for my purchases before the product had been shipped. At that point you then have a set of post-purchase rights which often means you can get the situation resolved swiftly.

I have had a few naughty e-tailers take the money for my purchases before the product had been shipped. At that point you then have a set of post-purchase rights which often means you can get the situation resolved swiftly.

From speaking with my bank the money has been set aside for overclockers who decided the next day to cancel it. i got an email from overclockers saying it was cancelled:

This order has been cancelled and all monies refunded to the credit/debit card used.

but i still cannot use the funds that were for overclockers.
 
I will if i get time around work. But i expect the same as yesterday to be told effectively that its not there problem even though the bank said its for overclockers to sort out so now im the one whos been put out as i need a new computer and i couldnt order it this weekend as the funds are not available.

So far im losing money from ringing them about a mess up they made.

And my sigs changed again. Now where were we.. oh yea.. prices. Rawr! Evil corporations etc...
 
Well ive had a reply and they said my funds will take 3 - 5 days for me to use them again. so for a week im without a pc or the funds with which to buy one.

no appology for wasted time and generally quite rude the best part though is saying that customer service is a high priority to them and admitting that the error was made by them yet in the same sentance saying that i needed to use common sense???

telling a customer they need to use common sense is not exactly great customer service especially when your error has cost them money and you have just told them you wont honour the item and they cant get at the funds for a week potentially.

what happened to the loyal, respectful and honourable old OCUK that are displayed on the companies facebook page since they have not honoured anything they have not been respectful and they are not loyal.

Sounds like a copy and paste job. GREAT customer service A+ they are so positive about customer service they dont have time to send a personal reply to a customer
