Hey all,

Just a quickie.. (wanted to get more replies hence the thread being in here)

Got my bro an 80GB iPod on Saturday, his birthday was today so I gave him the box and he opened it (you know the score).

Anyway, he opens the box, unpacks the iPod and powers it up... only to find an endless loop of Apple Logo, click, Apple Logo, Click....

Question: Is the store I bought from oblidged to replace it with a new iPod because it was DOA, or can they say it will need repair? Frankly, I will go off-the-wall if they make me pay for something that was broke when I bought it.

Thanks in advance, from a very peeved EVH

DOA normaly gets you a direct replacment from stores if you go in and get it sorted
as its an iPod it may be different tho, but go in and give them hell!

Depends how long it has been since you purchased it I would expect, but Apple don't repair iPods, they just replace them for you anyway, normally takes a few days for new ones to be sent out.

That's a load off then!

At the moment it's doing a lovely cycle of restarts in the cupboard.. wish it would die already

Am I right in thinking I can use "not sold as advertised" as my argument if they are funny about replacing?

You don;t need to be funny about it at all. Take it in, slap it on the counter, say "I bought this on Saturday & it doesn't work", et voila - new iPod.

Have you reset it?
Oh you're not entitled to a replacement if you've had it for some time, leaving it boxed up and only finding out it's faulty weeks/months later.

I'm sorry to hear about that. Take it into an Apple Store and you will get it sorted straight away.

Taking it back to the reseller would mean that they have to send it to us just to verify the problems.

Have you tried the support forums to see if it's a simple fix.

Try holding the Menu + Select button for 6 seconds to reset the iPod and see if that helps.

Toose

Why didn't you like try walking into the place you got it/sending it back and explaining the problem

I don't get it :/

Did you try restoring it?? Have a look on the Apple website maybe it can help you out. If you take it into a store they will give you a direct replacement:)

Ok maybe I should have explained a little clearer.

Bought it Saturday (3 days ago).

Gave it to my brother TODAY and found out it was broke.

I have tried resetting many times, and it just starts the whole cycling thing off again... Apple Logo, Click, Apple Logo, Click...

I jcan't go back to the store until this coming Saturday as I work 8:30am - 5:00pm 5 days a week :( ..see what they say on the phone I guess.

I hope they don't make me wait by sending it away, as the store is a 60 miles drive and will suck up most of my weekend

.. Ideally a replacement is what I want

Why do people create these threads? If I had anything that was DOA or faulty that was less than a year old or a couple of days old or under under some form of warranty the first thing i would is contact the place i bought and get clear precise information about how to go forward. That is surely better than asking a load of strangers on the internet.

everyone realises apple products are subject to the same laws as any other companies products right - we might all like them, but they're not really special.

correct, if the dealer tries telling him that it needs to go away for whatever reason then they are in breach of the sale of goods act

Some people work all day, and don't have the time to contact the store...seeing as I found out after office hours

Also, some members here work in this area (computer retail) and would be able to tell me the likely form of procedure in these circumstances which is all I wanted to know.

Obviously, my first port of call is to ring the store on my break tomorrow and find out exactly how I will go about sorting it out (which I knew anyway), but it's always nice to hear from people who perhaps might have been in the same boat at some point.

I'd ask yourself why people make the countless other stupid threads in GD, but I'd like to think asking for help is not a waste of time.. *sigh*

Surely you must know your rights, if something doesn't work, take it back to the shop and they replace it or give you a refund, my iRiver broke after 2 months and the shop gave me a refund (varies shop to shop though but you're still entitled to an exchange)
