Dolphin 35 contract problems

Hi Guys,

My housemate is having some trouble with Orange. In January he received a bill for £96 from Orange. He rang them and they said he used 600 more texts than his contract 500. Now he's regularly gone over 500 texts, but thats purely because his contract is meant to be unlimited. Now his phone has been cut off, for non-pay, but Orange had said when he first contacted them they wouldn't cut him off.

We've done some digging online, and found numerous adverts and reviews of the contract from when he took it out (2006 some time) that clearly state unlimited texts.

Orange have told him the contract changed, but he's never received notice of this. Looking online now, and Dolphin 35 still says unlimited texts, and Orange have confirmed he's still on Dolphin 35.

Has anyone else encountered this problem, or can give any advice on how he can resolve this? Orange customer services just aren't playing ball at the moment.
 
did you get the phone from orange themselves or from another company? CPW. P4U etc.

Contracts change all the time, Up until nov 2007 or so, CPW were still selling Dolphin 35 with 500mins/500txts. If he has gone over the 500 before and not been charged, then Orange are at fault if they have not notified him.

Best bet would be to find the original copy of the contract and see what that says, it's usually the best bargaining chip against the network
 
orange been screewing me over as well. My contract was 25 quid a month and unlimited texts after 7 and on weekends. They charged me for my unlimited textas and made it 30 quid a month contract.
 
There have been two types of Dolphin 35 contract in the past (and maybe so now, I'm a little out of touch with the market).

Dolphin 35 - 500min / unlimited text
Dolphin 35 - 500min / 500 texts

It would depend to which one he signed up to at the time (both Orange themselves and third parties have had both versions at a given time) to what allowance he gets.

Basically, if he signed up to the 500min / 500 text one (which it will state in his original T&C) then he hasn't got a leg to stand on unfortunately.

Orange can, and often do (like many providers) change their terms and conditions for new and existing customers from time to time.

It also states they are allowed to do this within the contract he agreed to unfortunately.

I think the likely scenario here is the guy has signed up to the 500/500 deal and then noticed the 500/unlimited deal and 'assumed' he had that due to it being advertised under the same guise of 'Dolphin 35'. The only way to be sure is to dig up your original paperwork.. good luck however, if he did sign up to the unlimited deal and it was simply applied wrong, then chances are they will refund him :)
 
I'm on Dolphin 35 and signed up just after they added the unltd txts (500 mins)
The newer contracts are 600mins and unltd txts now :(
