Drink Driving - End of Ban

You dont get a ban, your license is revoked and you have to reapply, sit theory and then practical

That's how I understood it.
DR10 is an automatic disqualification, ie no points are given, and the ban aimed at new drivers seems to focus on them earning six points in two years.

I work in the court.

Unless the court specified that you needed to take an extended re-test then you do not have too.

If you are still unsure, ring the court and they will be able to give you a result.

My brother who is 23 got his back just last month. Was banned for 20 months for DUI but did a course and had it reduced to 15 months. He just had to apply to the DVLA for a new license..

Worth noting as the OP said he was 3.5 times over the limit.

Drivers disqualified for drinking and driving twice within 10 years, or once if they are over two and a half times the legal limit, or those who refused to give a specimen, also have to satisfy the Driver and Vehicle Licensing Agency’s Medical Branch that they do not have an alcohol problem and are otherwise fit to drive before their licence is returned at the end of their period of disqualification.

its entirely at the magistrates choosing

if the magistrate deemed he should have to re-take his test, then he culd have forced him too. He appears not to have though.

The problem here is not with the rules. If you disagree with anything, its the judgement of the magistrate.

Well after the court date I had to attend a 3 day 1 to 1 with someone to make sure that I did not have an issue with drink, and they were satisfied that it was not an alcohol problem.

The 6 points in 2 years thing is harsh but it does make sense to ban people who are consistently caught speeding.

Drink driving is a far far more serious offence, but so is speeding constantly, they are both very dangerous and cause a hazard to the people around you.


Either way, I have learnt my lesson and I never plan on doing it again, and Im gonna send my form back and see what happens thanks for the input guys.

Personally I doubt you were 3.5 times over the limit unless you were an alcoholic - although if you don't remember getting in the car it was possible. Registering a 0.28 BAC is incredibly hard. Either you were very small or you drank a whole bottle of spirits within 2 hours.

When I had to reapply i just completed the form and my license came back suitably endorsed.

That was a while ago so not sure if they've changed the requirements.
