Driving Other Than In Accordance With A Licence

What exactly does this mean? I have to go to court tomorrow and I am charged with Driving Other Than In Accordance With A Licence, Driving a vehicle without a valid test certificate and driving without insurance. Obviously I know what the last two mean but what about the first one?

The offence I was arrested for was driving with excess alcohol. So I thought the first 3 were just to get me to prove my documentation but now I am not so sure.
 
I was not given a producer, I took my documents to the station the next day. All my documents were valid at the time of the offence.
 
It usually means you are driving something not covered by your license.. e.g. a HGV if you don't have it listed on the paper bit of your license.

Not sure how that applies though.
 
Uninsured drivers :mad: But I'm not gonna get into that here, maybe you had your reasons.

It means you were driving a vehicle without a license basically, I assume that is you have no license at all, or only a motorcycle license but you were driving a car.
 
Yes I can prove I am insured and have a valid mot and licence. So I don't quite understand it.
 
I think the first offence would be for example if you had a provisional license and were driving without following the restrictions of said licence (i.e. L plates and the supervision of someone 21+ with 3 years experience).
 
Uhh... why would they charge you with it then? Did you not tell the police you were?

It doesn't matter anyway just make sure you take the paperwork to court IE your insurance certificate, test pass certificate, drivers license etc. and the case will be dropped.
 
Unless there's something you're not telling us, it sounds like an admin error to me...

Thats what I was trying to find out, I am not sure if I plead guilty or not to the licence insurance and mot charges as well as the driving with excess alcohol one.

MOT one I dont understand, but if your charged with drink driving, doesnt that technically mean your also uninsured as they obviously wouldnt cover you if your drunk?

You will find that your insurer 'reserves the right to restrict cover to that required by the Road Traffic Act' if you are driving under the influence.

You are still insured, but they:

a) Won't pay out for your car
b) Are entitled to sue you to recover anything they have to payout to a third party.
 
I'm not entirely sure, looking for clarification on that. But my drunkeness surely doesn't affect the MOT certificate which I was also charged for.

Yes you will.

Thinking about it, I knew they would pay out to 3rd parties only, my friend crashed his car with a load of mod's and nothing was said and he recieved a full payout.

Driving a vehicle you have no licence for, as far as I've understood it.

E.G, A Car driver in an HGV, or pulling a caravan thats heavier than your licence allows for etc.

Its a bit irrelevent though, your excess alcohol charge would be the one worrying me!
 
They have probably charged you with that because at the time of the offence they arrested you for, you couldnt prove you had a licence, MOT or insurance on the spot so they charged you with that - when you CAN prove you had all of that at the time they should drop the charges...

That is my (limited) understanding/guesstimation of it anyway.
