I recently contacted the Department of Works and Pensions over an alleged overpayment they have made to one of my employees. They had previously asked the employee if he disputed the amount and whether he requested a mandatory reconsideration. I said yes (acting on his behalf) because their figures outstanding didn't add up and he shouldn't have a civil penalty added to any amount outstanding since he had acted in good faith and according to their own rules. They have replied to the same individual, ignoring my previous comments, threatening with an attachment of earnings order and/or a debt collection agency. How can they legally be entitled to ignore their own rules and behave in a bullying way to one of their ex clients is beyond me? Does anybody know if they are able to carry out these threats without having to prove their actions are justifiable.

In their previous correspondence their client was given the option of a mandatory reconsideration ( which he has to take regarding any dispute). Only after this process can he appeal. The latest letter to him has ignored this process despite him adhering to it ?
 
They are hilarious - made them aware once of a significant overpayment (a few zeros) on their part and they didn't want to know, while playing hard ball over an owed £18 that actually was already settled.
 
had it myself. i worked a 12 hour night shift while signing on, informed my adviser about it they said ok leave it at that. 3 years later i get a letter saying im being investigated for fraud. end up having to pay back £70 or there abouts when i asked why it took 3 years for them to realise they said "well its normally picked up within 6 months" i guess if these group of civil servants get out foxed by people not trying to dodge tax or payments god help the HMRC.
 
It's absolutely criminal the way this Government department behaves. Having just spoken to them stating my employee disputes the amount of overpayment according to his bank statements, they still refuse to hold off with the attachment of earnings order or debt collector because the Department that deals with the appeal process is a different department. The dispute regarding the issue of a civil penalty still stands until they hear otherwise. Basically this amounts to taking money from an individual which is yet to be confirmed beyond any doubt that it is owed. He has also been denied the chance to appeal or receive a mandatory reconsideration.

Its HMRC I've had issue with.

DWP I know through my mum are totally and utterly incompetent. They are not paying her but said they will stop her money. Then because she had a payment from my Nan they sent a letter saying something along the lines of we believe there is fraud and another account. we require proof that the other account is not in any way related to you. Scum... Pure and simple. Go and investigate Gideon and IDS to see what swindles they are doing with their millions.

Why on earth are you trying to deal with this instead of letting your employee do it?
 
The DWP commits more fraud than most organisations trying to con claimants out of their entitlements. They conned me out of thirty years benefit and I have been told by a retired solicitor that I am still entitled to what I didn’t get as an ex-gratia payment. Every route I take trying to get some of the £100,000 they have conned me out of they keep trying to obstruct me with bureaucracy. It is still all fraud as they are trying to make themselves look innocent when they are acting fraudulently. They are devious, corrupt, morally perverted and inferior.
I will never trust anyone who has worked for this criminal organisation.
I am not going to be silenced by these pervs in government.

I used to work for a company that regularly dealt with local councils and government departments. Believe me, you have never met a more dysfunctional bunch of idiots in all your life. I really don't understand why so many of them are so clueless. If private business ran like this the world would completely collapse in a month.
Part of the problem seems to be sheer arrogance. Instead of finding out, or asking experts, they just assume they know what they are talking about and make decisions accordingly. Time and time again they make the wrong decisions but they are never held accountable. It's truly unbelievable.
