ebay fraud

Hey chaps, I thought I'd post this in GD rather than the memory forum since there's more people here who could give advice on ebay fraud.

I've been helping one of OcUK's members 'phil2008' with replies to a seller he purchased from last week, since phil has cerebral palsy. Here's phil's original thread

It seems he's been conned by someone who is a new seller and no feedback as such. phil received a pendrive today after over a week long wait, and it turns out to be fake. Here's some correspondence between them from this week, with replies composed by me that phil then sent to him.

So now, I've just composed this for phil to send to the seller and I wonder what you think of it. Shall we send it as is, or does it need anything changing?

I have received the 64GB USB 2.0 Corsair Flash Voyager and it is in fact, fake.

I have this proof:

1. No accessories
2. Blue led light is missing
3. I can bend about a quarter of the rubber at the end where the led light is meant to be
4. No numbers/sn on the rubber
5. The blue rubs off on my hands
6. It won't format to NTFS, only to exFat
7 The lid/cover is squashy

A genuine Corsair has none of these faults.

You failed to dispatch the item immediately after payment was received and cleared from me last Friday 16th March as stated would happen as per the listing's delivery clause.

You said you were out of the country during this time and that you had put it on your account. There was no such notice.


** You said it was dispatched on Tuesday 20th March, but the poststamping on the envelope says 23rd March, which was yesterday, Friday.

Your listing stated postage is 5 Euros (approx £4.18) yet on closer inspection, the poststamping on the envelope says £1.58. So apparently I've been overcharged.

As you can see, you have been negligent and have misled me in several ways. I will now expect a full refund from you, and you will be reported to Ebay.

Thank you."

** Before we accuse him of only sending yesterday instead of tuesday, can someone tell me if the date on this stamp (23/3/12) would be when it was sent or when it would have been received at the depot in the UK? It was sent from Ireland. You can also see the actual cost of the postage on the picture.

what did you expect, it was probably cheap as well

if its too good to be true it normally is, cheaper than most other retailers and on ebay = fake!
 
I hate scumbags who do things like this. Give me the sellers account name and i'll seriously fraud him out of everything he's selling just to even things up a bit :)
 
i would just make a claim for a fake, but i think you are better claiming this on ebay rather than paypal as i am sure with paypal you have to prove its a fake and with ebay the seller has to prove it

So he shouldn't send that message I composed to the seller first, just go straight to ebay?

you could do but just cut to the chase, he claims it not a fake you do, get ebay to decide for you and ignore the seller messing you around


edit: also i believe that if it is decided a fake you wont have to send it back and will get a refund

I would personally leave that bit out, unless ebay has some specific terms and conditions regarding this. As far as i am aware the cost of postage is the business of the seller as long as he informs you of what YOU are being charged for postage, what it actually costs is immaterial.
 
I'd not bother worrying about the postage and packaging thing, worry about the item. Although annoying he could argue postage and packaging includes not only the postage but the packaging materials, time to pack it, time and cost to get it to post office etc.

Might be worth buying as many as possable and then filling a claim on ebay then just to make sure he's proper out of pocket and learns a harsh harsh lesson in morality.Nothing hurts a scammer more than being scammed in their own scam.:p
 
Great, thanks for the advice guys. I guess we'll get onto ebay now then. We'll leave the postage cost out.

Just one more thing though regarding postage. The date stamp on the envelope saying 23/3/12, would that be the date he actually posted it, or is it likely he could actually have posted it on tuesday 20th as he says and the date stamp is done when received at this end?

I have a genuine (I hope!) 32GB USB 3.0 Corsair Flash Voyager from OcUK.

Based on this these are my comments on your points:

1. There are no accessories, it's just the USB stick in a blister pack
2. Fair enough
3. Not on mine
4. There is no serial number on the rubber but there are some numbers on the metal USB connector
5. Not on mine
6. Mine will format to NTFS
7. The lid/cover is squashy, it's a similar rubber material to the body of the drive

So I'd say points 2, 3, 5, 6 and possibly 4 are valid complaints.

Interesting, thanks! Are you absolutely positive it's the day he sent and not the day received at the depot on UK mainland? In that case, I've added that to my ebay report.

It arrived only today Saturday 24th March. The delivery clause on the seller's listing states the item would be immediately dispatched after payment has cleared. Payment was cleared via Paypal on the 16th. The item however was not dispatched immediately or anywhere close to that. The seller told me just a couple of days ago that he was out of the country and had put that information on his account, (I could not find this information anywhere on his account) and that he had sent the item on Tuesday the 20th. I have the envelope that the item came in, and the date stamp shows '23/3/12', which means he didn't even send it until yesterday, Friday 23rd March. I can provide you with photo proof of this and anything else you require.

The item turns out to be fake, by this criteria:


1. Blue led light is missing
2. I can bend about a quarter of the rubber at the end where the led light is meant to be
3. No numbers and serial number on the metal plug.
4. The blue rubs off on my hands
5. It won't format to NTFS, only to exFat


A genuine Corsair has none of these things.

Has the capacity of the drive been tested?

If it's a fake then, assuming it works at all, it'll be a lower capacity.

That would seem to be one of the big things to add to the report.

phil is offline on MSN at the moment. But an hour and a half ago, he was testing it and at that point, he showed me this:

I think you are making this far more difficult than it ought to be. You have grounds to believe the product is fake, list why and let eBay's buyer protection kick in. You WILL get your money back but probably aren't going to stop the countless other fake items on eBay.
 
It's probaly just fooling Windows into thinking it's writing that much data.

When he looks at the contents of the drive then all the data supposedly copied won't be there.

How so? I'm just trying to find out the best way to do it and to be as clear and factually correct as possible on behalf of phil. I think we pretty much have it sorted now and when phil comes back online, he can send it to ebay.
