Ebay issue

I ordered something over two weeks ago via ebay, and is not turned up. The seller sent me a tracking code because the item was sent using royal mail recorded delivery. I input this code and it basically says that the item has not been delivered yet so it cant track it, so i assume its lost.

I've contacted the seller to let him know and basically he is telling me that i need to make a claim for it with royal mail. He e-mailed me a scan of his postage receipt to prove that he sent it. I've never done it this way round before, i thought it was the seller that made the claim with royal mail as i thought you needed the original receipts to prove it.

However after looking around on the RM site i found this form:

That mentions something on it about ebay claims so looks right.

Should i fill this in or is the seller telling me porkies?

Its quite likely that its been lost in the post mate. Same thing happened to me a few weeks ago so the seller sent me another one. Apparently he lost like 50 units in the post.

The delivery time is upto the Courier, once the item has been posted they have done their bit really.

Definatley go through ebay's procedure as he should be helping you to get this sorted.

The courier is a sub contractor for the seller though. It is the responsibility of the seller to get items to you. That is why you should not pay postal insurance.
 
tell him to first fully refund you, and then he can chase up Royal Mail to get it back/refund

agreed, he is responsible for you receiving it in good condition and uses RM to do this. He has the contract with RM so he has to file the investigation
 
It's up to the seller to chase after compensation if it's been lost, I've unfortunately been there a few times. Afterall he is the customer who paid Royal Mail to deliver it, he's got the original recorded delivery slip, he needs to get down to the post office and fill in a claims form and enclose the actual recorded slip with it. Whenever this has happened to something I've posted, I've refunded the buyer. He should ideally do the same. It'll be 3-4 weeks before you get anything back from Royal Mail.
 
Yup as far as you are concerned you paid and have not had the goods. So open up an ebay invertiagtion to reclaim your money. A tracking number isnt proof of delivery..... its the sellers problem to deal with NOT yours.
 
Ok thanks for the response guys. I have contacted the seller and asked for refund and told him to sort out the royal mail claim. If i don't receive a refund shortly ill take it to a paypal dispute.

No. For a while now ebay has put this message in small print at the bottom of every listing next to the postage charges:

Sellers are not responsible for delivery time. This information is provided by the carrier and excludes weekends and bank holidays. Note that delivery times may vary, particularly during peak periods.

To hell with that. Start a Paypal resoloution, and give them a day before escelating the claim.

whats that got to do with anything? that just means that if its 1st class and it says it will arrive in 1-2 days, that its not guaranteed and might arrive in 3 or 4 or whatever. thats got nothing to do with the seller making sure you get the item.
