eBay/Paypal help : Bought two tyres which are faulty: What to do?

Hi,

I purchased two tyres at the tail end of July from an eBay business seller. They arrived and have been sat in my shed till today when I went to a local fitter to have them fitted and balanced. Both tyres were described as 'as new' and certainly looked like it when they were delivered but upon fitting to the wheels the fitter discovered 4 long cuts right through the tyre on the sidewalls of both tyres.

I'm not sure what course of action to take now as I've never raised a dispute on eBay before, any advice appreciated. What chances have I got of getting anything back?. :(
 
After this much time has elapsed I'd imagine you are going to have real trouble in convincing anyone that you aren't trying to pull a fast one. :(
 
yup, should have checked them when they arrived.

(I know you obviously did check them, but this I would imagine is the stance that ebay and the seller will take)
 
Are they on your car right now?

It will just sound like you put them on, messed them up and now want a refund.

It's too late to kick up a fuss..
 
Not on the car, no. The tyres haven't turned a mile, they still have the sheen of the release agent on their surface and the little 'bobbly bits' across the surface of the tread.

They were placed in my shed packaged up as they were when they arrived ( taped up together ). I know in hindsight I should have removed the tape and had a good check of them but I didn't think to do so as they looked 'as new' otherwise. I've messaged the seller to see what happens now.

Yes, just. It's day 41 since purchase. Is there a difference between raising a dispute via eBay in comparison to Paypal?.

I'd raise it with paypal against the relevant transaction, pretty much guaranteed to get your money back. I'm willing to bet the seller will try to say you've deliberately damaged them though.

How does the process work?. As I said, been buying on eBay for years and never had to raise a dispute so this is all new to me.

I would expect that is a likely possibility. I just wish I had split the two tyres and carried out a thorough inspection of them when they were first delivered.

Pic above, I've just taken a couple of the cuts in the sidewalls too.

One tyre has the cut as shown above, the other has two cuts similar about 6 inches apart.

I'd link to the eBay listing but I'd rather not at this stage so as to give the seller the benefit of the doubt.

From the pictures the cut looks like a non-issue anyway.....

Once the tyres were on the rims and pressurised, the fitter pointed out the cuts which go right through the sidewall. Air was escaping quickly from them. In the last 20 mins I've had the seller message me via ebay, offering a full refund. I'm in the process of having a dialogue with him just now to sort it out. :cool:
 
That's incredible that the eBay seller will refund you after all this time. I wonder how that could have happened, it doesn't look like a neat cut as if they had been scratched so perhaps the courier didn't handle them very well and something was placed on top causing them to stretch and break that way? That's the only explanation I can think of.

If he is a legitimate seller with great feedback I see no reason why he wouldn't act in this way, although he may just be delaying it for 4 more days...

You basically have 45 days from receipt to raise the dispute and escalate it to a claim, paypal email the dispute details to the seller, then if you don't get anywhere you escalate it to a claim and Paypal make a decision on it (buyers pretty much always win in this situation). As you're very close to the paypal deadline I'd make the seller aware that you'd need a refund quickly.
 
Update - Seller has fully refunded including postage costs. I asked him how he wanted to go about having the tyres returned and he said not to bother, he would rather I disposed of them instead of either of us incurring costs to have them couriered back. Not sure what to make of it all, I'm just glad I've had my money returned.
 
Standard ebay, people sell tat or knackered stuff. I will only buy things that are cheap / new or collected in person on ebay for this reason....

/edit: I imagine the seller knows they are caught red handed.
