Ebay Paypal Problem

Right, i recently sold something on Ebay. The guy paid immediately via Paypal.

I then sent the item to the guy a few days ago.

Now i get this message:

Hi,
I recentley bought a hard drive from you. The item was recieved very fast (thank you) however it does not work. I took it to an it shop and they said that apparantley the system does not recognise the hardwares id.
Could you please refund me my money and I shall put it back in the post for you as soon as the money is recieved.
Thank you very much.

I replied, as it was working when i sent it, and im not willing to refund.

What shall i do from this point?

Tell him to stuff it, and keep the email. He will try to do a charge back, so as long as you kept the proof of postage you will win with Paypal. Send them the email he has sent you as proof that he has received it.

You win. He might leave you negative feedback though...tell him to RMA it if he's not happy.

Please, whatever you do ignore this idiot.

There are 2 choices, it either works and hes trying to con you or its broken in the post - which happens.

Go through the postal insurance route mentioned above, were you illegible for seller protection? ie Has he a confirmed address.
 
Yeah, he has a confirmed address, in London.

Im just worried as i dont want to loose out, as i have sent him a working item, which was very well packaged, and i dont want to loose the money.

Im abit worried as he wants the money refunded then he will send the goods. Im abit confused as he has to agree with my terms as the seller, not to his own terms.
 
Hard drives are fairly sensitive devices, so it is plausible that it could have been damaged in transit. It is however just as likely his own hard drive died, and he's buying an identical one from you then sending back the broken one.

Take control of the situation and TELL him that he can send the drive back for inspection, if the drive is found to be faulty then you will provide a full refund. Make it clear though that the drive is his responsability until it is back with you (including what delivery method he chooses). Make no guarantees of any refund at all until you have inspected the drive yourself.

You might also want to tell him that you will only refund him once the insurance for the drive has gone through.

The last bit is hardly fair to the buyer if it RY genuinely broke it.

I guess its assumed really,

With a harddrive its so difficult to say, the buyer could have just broken it easily and now you have to pay up for it.

Having been a full time Ebayer with over 5000+ feedbacks, generally, if the item was well packaged its doesnt break. What I find is strange is that he wants the money refunded first. It just sounds like a con to me.

I have sent lots and lots of hard drives through the mail and not one ever arrived dead.

I would still remain tough, tell him it left you working. He is welcome to claim from the RM, do not refund if you dont want to. Have you ever tried to claim from the RM if the parcel was well packaged. I did have an incident once with a £350 processor that I bought. It took months and months, and in the end the RM didnt refund and I was left with a duff processor and no money...

As for calling me an idiot, why? You dont know me.

NO PERSONAL ATTACKS I THINK THE RULES STATE...
 
Did you offer returns with the EBay return policy or in your term and conditions? If yes then the he has a leg to stand on, if you did'nt then its his problem not yours; as he was willing to purchase an listed item without returns option offerd by seller. ;)

Is it that simple according to T&Cs of ebay/paypal

Where will paypal go if he claims?
I think he can reasonably expect the item to be working when it arrived unless advertised otherwise.

Pretty much yes, theres now a user friendly option (since March) when you set up adverts to offer returns and or postal insurance, if you choose not too (thats the default mode for set up page), then Buyers purchase there own risk.

I don't offer postal insurance but I send the item with RMSD can the buyer not assume insurance? I guess that is a obvious case.

So you are 100% that ebay/paypal would side with the seller in this case?

Well, obviously if the seller has a pretty dire history then hard to say, but if hes 100% or very close too, then tbh i cant see them siding with buyer on this one. I have won a claim through paypal but then i read adverts small print, was only reason got my money back as the guy didnt pack item to survive postal trip at all.

I called you an idiot as to your reply, "Tell him to stuff it". If thats not the response of an idiot I dont know what is. I feel sorry for anyone who deals with you over ebay and has a genuine problem if thats your attitude. How do you know he will do a charge back? You cant, and at the point of yout post there was no indication that the seller was protected, so simply saying the seller will win with proof of postage is completely incorrect. If you really have dealt on ebay to the extent you claim to, then I think its slightly naive of you to think so and it might be worth reading up on the actual terms and conditions relating to receiving payment via Paypal.

And yes, Ive claimed for a broken mobile phone via Royal Mail, through a deal on these very forums. Was tidied up in a month or so I think, yes a hassle but these things take time.

It could quite easily be a scam and probably is, but its also possible that its genuine and some guy has just received a duff item. You have to be reasonable enough just in case it is actually genuine.
 
Well, i guess its all speculation at the moment, as i havn't recieved a "Resolution Notice" yet.

I will update this topic once i have recieved anything about it, if i do that is.

Also i have 100% feedback as a seller and buyer. I have sold lots of items in the past without problem. Including lots of computer related items.
 
Did you send the item by recorded delivery/special delivery ? If so then you can prove to paypal that it was delivered if he tries to make a chargeback.
The buyer will have to return the faulty item at his expense by a trackable means before you issue any refund.
