ebay problem and getting police involved

Here we go again :rolleyes:

Two weeks ago I sold a Sapphire R280X Toxic OC and a Nexus 4 mobile phone. They sold to two different people for around the same amount (£170ish).

Like the good seller I am, they were all ready boxed up so I printed the labels out and sent them on their way. Unfortunately, tired me only went and posted them both to the same buyer. The guy who bought the graphics card ended up getting both the graphics card and mobile phone :eek:

I immediately contacted the buyer who seemed ok, now reading back he was only interested in finding out when the graphics card would arrive, but did agree to send the phone on to the correct address if I paid him the postage. Decided to do the honourable thing and send him £20, to cover not only the postage but the time in going to the post office.

The next day I did the parcelforce track and trace and could see both parcels had been delivered and signed for.

Two weeks later, multiple emails to him and I've not heard a thing :mad:

Contacted ebay last night, told them everything and they basically said they are treating it as theft and to contact the police :eek: Seems it's quite common.

Kicking myself now!!!! Really need to be extra careful when printing out postage labels, and to drink three coffees before! Shall be having a few vodkas and cokes tonight!
 
I'm surprised (but glad) eBay took this stance. I take it all communication was through eBay and this has helped your case?

Yes, everything was through ebay. I've got a url to give the police, and the transcript of our chat.

I'll be writing everything down for the police and will pop in to see them tomorrow. Not really looking forward to it, but people can't get away with this stuff. I've been trying to come up with reasons why the buyer has stopped talking to me, but after two weeks you'd think I'd get something back. Even if he was going on holiday, you'd think he'd have told me the parcel would be sat at his house not going anywhere. It's just the not knowing!
 
I can't believe the original buyer of the phone has not already got a refund after more than two weeks? A Paypal dispute would have even been resolved by now in the buyer's favour. Your original phone buyer must be very understanding of you to wait this long.

Yes they were, I did keep them fully updated as to what was going on.
 
The buyer of the phone was happy to wait for it to be resolved. Nexus 4 was 100% pristine and they really wanted it.

When they said about a refund, they said see if you can find out anymore and if not refund me. That's what I did.
 
No update yet, I spent the weekend printing out the ebay ads, ebay messages, paypal transactions, parcelforce tracking info etc etc etc

Just waiting for an email from parcelforce confirming where the phone was delivered to before going to see pc plod

Mum (good old mum) has said it's no problem getting one of the solicitors to send him a letter either.

Will have an update before the end of the week I would have thought
 
Update

Parcelforce has come back to me saying that the parcel was delivered to a neighbour, but due to the data protection act they are unable to tell me where it is. The website just says delivered, no address or anything. (a squiggle as a signature as well).

Since the buyer is not replying to any of my emails, there is nothing I can do.

I can't prove for a FACT where the phone is. The neighbour most likely dropped it round, but since I can't prove it I'm stumped.

The only thing I have in writing is that the buyer said he would send it on if I gave him postage money, not that he actually had it in his possession. Since he is not replying back to me, I can only think the worst.

Google tracking last reported the phone was on four weeks ago. Not sure if it looks at the IMEI, sim or user account?

Guess that's that then.
 
well just to clear everything up (and for my own sanity) this was the sequence of events

1. Sold Phone and Graphics Card on ebay to seperate people
2. Post Phone to guy who bought the graphics card by mistake
3. Realise my mistake and contact him. He replies saying no problem, want my graphics card asap. Will send phone on for postage money. PayPal him £20. In the meantime I ring parcelforce to see if I can get the phone back before its delivered and get told No!
4. Post Graphics Card to correct buyer

Parcelforce deliver Phone to wrong buyers neighbour
Parcelforce deliver Graphics Card the next day

Buyer suddenly goes quiet. Buyer of phone is understanding, but in the end I give refund as no idea what to do next. Parcelforce won't give me details of where the phone was actual delivered to.

Seller gets himself into a depressed state, hits the vodka, remortgages house and puts equity release all on red....it comes up black. Seller never posts on ocuk again

I can now see on our tracking that the parcel you are enquiring about was delivered on the 16/04/2014 at 09:26 signed "ECCLES T 17". This indicates that the item was delivered to a neighbour of the original delivery address, as per per delivery terms. Unfortunately due to Data Protection I can not provide you with the delivery address.

If the wrong address has been applied to the parcel and we have successfully delivered to that address (or neighbour in this case) there is nothing that can be done to retrieve your item as this has been delivered correctly.

UPDATE:

Good old mum spoke to her boss about the missing phone. He didn't take kindly to hearing about the theft so decided to write him a letter. The letter came direct from the solicitors and contained numerous theft and postal laws. He gave him 14 days to return the phone else legal proceedings would ensue.

Two days later the phone arrived by mr postman!
