I sold a processor over Ebay at the end of November last year. The buyer paid by Paypal and I sent it off. I had fully tested the item but stated in the auction there was no warranty and assume it is untested.

The buyer emailed me to say he had received but wasn't going to use it until he returned home to Poland at Xmas.

I didn't hear anything and he never left any feedback. However I got a email today saying he thinks the processor is faulty and would like a refund. He has had it 3 months now. He reckons if he doesn't get a full refund he will lodge a complaint with Paypal.

I think hes got an incompatible motherboard but he wont listen. I can't really help him any further but he insists he will get a refund off Pay pal. Is this likely?

After three months I wouldn't consider it - it's outside (by a long shot) the normal ammount of time to return something. you wouldn't go back to Currys with a dishwasher saying it was packaged in your garage for 3 months while you went away on holiday.

In my opinion I don't think he has a leg to stand on and should have tested the CPU on his motherboard before he left.

funnily enough ive had an email from an ebayer about my 4600x2 i sold in jan. he says his pc has started crashing and hes using his old cpu now and its all ok. He mentioned his motherboard and its deffo x2 compatible, however a cpu either works or doesnt as far as i know, I think hes been clocking it (it was a very very VERY bad clocker and was unstable at 2.6ghz on stock volts). I sent a few helpful emails and havnt heard anything since. he doesnt have a leg to stand on though. Sounds like you mans good giving old bit of Bull S to me hes just fried it and trying to get his money back!!

Im 99.99% sure there will be an ebay rule i nthe small print somewhere saying used items have 10 days to recify a problem. I agree with the 1st reply though totally. Say i bought a used ps2 from someone then 3 months later said it doesnt work they would say tuff

They should throw out his dispute without even investigating it. There's no way he can claim it back after all this time, especially if you put a disclaimer :)

i think theres a 45 day limit on how long you can wait till you can make a claim on paypal, so you got nothin to worry about

Someone did this to me so I escalated it to a claim when he filed for a dispute and it was auto rejected. PP said something about dealing with issues of delivery and not the item itself, I would say as long as you have a recorded delivery receipt you will be ok but this is eBay and PP heh.
